AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of
the City of Salina, Kansas, in the sum of $625,700.76, to pay the cost of constr-
ucting main sanitary sewers and certain lateral sanitary sewers and storm sewers
in the City of Salina, Kansas, which bonds shall be designated as Series 5-158.
WEREAS, pursuant to proceedings duly had according to law, certain main and certain
lateral sanitary sewers and storm sewers have been constructed in the City of Salina,
Kansas, in main sewer districts and certain lateral sanitary sewer districts, as
follows:
Main Sanitary Sewer District "DH -A", as provided for and authorized
by Ordinance Number 5673.
Lateral Sanitary Sewer Districts DH -1 to DH -32, inclusive, as pro-
vided for and authorized by Ordinance Number 5674.
Lateral Sanitary Sewer Districts DH -33 to DH -41, inclusive, as
provided for and authorized by Ordinance Number 5682
Ohio Street Storm Sewer, as provided for and authorized by
Ordinance Number 5722
Storm Sewer DA., DB., D -C & D -D, as provided for and authorized
by Ordinance Number 5683
rumpimg Station for Main Sewer DH -A, as provided for and authorized
by Ordinance Number 5708
WHEREAS, the total cost of said sewers constructed in and as the sewer districts
above mentioned and to be paid by special assessments levied upon lots and pieces
of ground liable for the payment of said sewers in the sewer districts above men-
tioned has been ascertained and is hereby found and determined to be the sum of
$227,419.46, which account has been heretofore duly assessed and apportioned to the
several lots and pieces of ground liable therefor according to law and as provided
for in the Ordinances of the City of Salina relating thereto, of which amount the
SUM of $128.37 has been paid by the owners of the property liable therefor, leaving
a balance for which bonds will be issued in the sum of $227,291.09
TaIHEREAS, the total cost of the said Storm Sewers has been ascertained in the amount
of $398,109.67 to be paid by general taxes to be levied upon all taxable property
within said city; and for which bonds are to be issued; and
WHMEA.S, bonds in the aggregate sum of
X25,700.76 are to be issued to pay the
actbal net cost thereof; NOW THEREFORE,
BEIT ORDAINED by the Board of Commissioners of the City of kSalina, Kansas:
Section 1. That the foregoing preambles are being hereby adopted and
made a part of this ordinance and that for the purpose of providing funds to
pay the cost of the improvements, hereinbefore described, there shall be
issued and there hereby are issued, Internal Improvement Bonds of the City
of Salina, Kansas, in the total principal sum of $625,700.76, which issue
shall consist of 625 bonds numbered from 1 to 625, inclusive, all dated July
12 1953, bonds numbered 1 to 126, inclusive, to bear interest from date at the
rate of three and one-half per cent per annum, and bonds numbered 127 to 625,
inclusive, to bear interest from date at the rate of two and one-half per
cent per annum, payable February 1, 1954, and thereafter semiannually on August
lst and February 1st of each year to be evidenced by interest coupons as herein
provided for, and said bonds shall become due serially in denomination as
follows:

Section 2. Said bonds shall be signed by the Mayor and shall be attested by
the signature of the City Clerk and the corporate seal of the City shall be affixed
thereto, and shall have attached thereto interest coupons representing the interest
thereon, which coupons shall be in the form provided by law and shall bear the
printed or lithographed facsimile signatures of the Mayor and the City Clerk of
said City and said bonds and interest coupons shall be registered in the offices of
the City Clerk and the State Auditor as required by law.
Section 3. Said bonds shall be designated as Series S-158, and shall be in
the form and shall contain recitals substantially as follows, to -wit:

the City of Salina,, Kansas, for the purpose of paying the cost of constructitnga
main sanitary sewer and certain lateral sanitary severs and storm sewers and a
romping Station, in said city by the authority of and in full compliance with the
provisions, restrictions and limitations of the constitution and laws of the State
of Kansas, including Sections 10-101 to 10-1261, Sections 12-617 to 12-620, Sections
12-626 to 12-629, and Sections 13-1013 to 13-1018, all in the General Statutes of
Kansas, 1949, and amendments thereto, and all other provisions of the laws of said
state applicable thereto and this bond and all other bonds of this series, all
interest thereon, are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and things
required to be dome aril to exist precedent to and in the issuance of this bond
have been properly done and performed and do exist in due and regular form and
manner as required by the constitution and laws of the State of Kansas, and that
the total indebtedness of said city, including this series of bonds, does not
exceed any constitutional or statutory limitations.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by
causing it to be signed by its Mayor and its corporate seal to be hamto affixed
attested by its City Clerk and the coupons hereto attached to be signed with the
facsimile signatures of said officers, and this bond to be dated the first day of

Section 4. The Mayor and the City Clerk are hereby authorized and directed
to prepare and execute the bonds hereinbefore described and to advertise to and
sell the same in the manner provided by law, and, when duly executed and register ed,
to deliver said bonds to the purchaser or purchasers thereof.

Section 5. The full faith, credit and resources of the City of Salina,
Kansas, shall be and the same are hereby irrevocably pledged for the prompt payment
I of said bonds and all interest thereon. The Board of Cc mnissioners of the City
i of Salina, Kansas, shall annually make provisions for the payment of the principal

and interest an said bonds, the same become due by levying taxes and assessments
upon the property liable therefor as provided by law.
Section 6. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
