AN LRDINANCt; relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas,to pay the cost of paving
and grading of Delaware Avenue from the north line of Iron Avenue to the south line
of Johnstown Avenue; for the paving and grading of Delaware Avenue from the north
line of Stapler Avenue to the north line of ; paving and grog

racifi.c Railroad right -of -war, west 29 feet more or less, to the east edge of ties
on railroad track; and relating to and providing for the collection and payment of
such assessments,

Section 1. For that purpose of paying for that part of the cost of improvements
of certain portions of certain streets as hereinafter set forth in the following
sections of this ordinance which is chargeable to the private property in the assess-
ment districts for each of such improvements, respectively, as set forth in the follow-
ing sections of this ordinance with respect to each of such improvements, there are
hereby levied and assessed on the property liable therefor, being all the lots and
pieces of ground lying, on either side of said streets so improved, respectively, to
the middle of the distance improved, with respect to the improvements mentioned in
Sections 213,4,516,718 and 9 of this ordinance, according to the appraised value of
such lots and pieces of groand with respect to each such improvement, without regard
to the buildings or improvements thereon, special assessments covering the cost of
such work and improvements and said special assessments being based on the special
valuation and appraisement of said lots and pieces of ground heretofore made by
three disinterested appraisers appointed by the Board of Commissioners of the City of
Salina, Kansas, with respect to each of suchimprovements, which said appraisements
are hereby referred to and made parts of this ordinance, and the several amounts levied,
apportioned and assessed against the lots and pieces of ground for each of such
improvements, respectively, for the purpose aforesaid, are hereby found and determined
to be the amounts set forth in the following sections of this ordinance with respect
to each of said improvements.
Section 2. For the paving and grading of Delaware Avenue from the north line
of Iron Avenue to the south line of Johnstown Avenue, which is chargeable against
the private property within the district chargeable the0efor, and which cost is
hereby determined to be $4,593.3u, there is hemeby levied, apportioned and assessed
against the following described lots and pieces of ground as provided for in Section

cost is hereby determined to be $524.66, there is hereby levied, apportioned and
assessed against the following described lots and pieces of ground as provided for
in Section 1 of this ordinance, the following amount:

Section 10. Said amounts levied, apportioned and assessed aforesaid will be
due and collectible in ten equal installments, the first becoming due with the
taxes levied for the year 1953 and one of said installments falling due each and every
year thereafter until all are paid, and all to be collected with interest as in
this ordinance provided, rRuVIUEll, HLUEVER, that the owner of any piece of property
liable for any assessment may, redeem his property from such liability by paying
into the City Treasury the entire amount chargeable against the same, as in this
ordinance provided, at any time within thirty days after the publication of this
i
ordinance and before the issuance of bonds of said city in payment of the balance
of the cost of said improvements, and the property so paid on sabt& shall not
thereafter be liablefor any further assessments for the cost of said improvements
nor for any part of said bonds.

Section U. There is hereby further levied and assessed against the lots
and pieces of ground described in this ordinance, interest at such a rate per annum
as shall be borne by the bonds hereafter to be issued for the payment ofthe
remaining unpaid cost of such improvements, to be hereafter determined and fixed
by ordinance when such bonds are issued, on all of said installments mentioned and
provided for in this ordinance, from the date of the bonds which may be issued at
the end of thirty days as specified in the proceeding sections hereof, as by law
provided, to the time of the collection of the last installment as provided by law,
which said interest shall be collected annually at the same time and in the same
manner as said installments are collected, and after the tatting effect of this

ordinance and the .fixing of said interest rate when such bonds are authorized and
issued, it shall be the duty of the City Clerk of said city to annually at the same
time other taxes are certified and until all of said installments and assessments
so apportioned and levied herein have been certified, to the 2wdq County Clerk cc
Saline County., Kansas, a fall list of all property liable to assessment and taxation
for such work and improvement, except such property on which the special assessment
aforesaid have been paid in full as hereinbefore provided, together with the respective
amounts due on each of such lots and pieces of land, which amounts shall include the
annual installments of such special assessments together with the interest for one
year at the rate to be fixed as provided for in this ordinance, on all unpaid
balances of such assessments, and such amounts so certified as herein provided shall
be placed upon the tax roll by the County Clerk of Saline County, Kansas, and
collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
