5784 FireworksORDINANCE NUMBER 57b4 (rublished in the Salina Journal�).At 1Z 1953) AN CRDIN4.NCE providing forthe amendment of Sections 13-701, 13-702, 13-703 and 13-709 of the Revised Ordinances of the City of Salina, Kansas, 1948, and farther providing for the repeal of the original of said sections. i BE IT O DAINSD by the Board of Commissioners of the City of Salina, Kansas: Section 1, That Section 13-701, Revised Ordinances of the City of Salina, Kansas, 1918, be and it is hereby amended to read as follows: "13-701. CERTAIN FZREW(RKS AUTHURIZED AND OTHER rROHIBITED. The sale, use and possession of the following articles of fireworks within the City of Salina.. Kansas, is hereby approved, except that prohibited items may be used for public display j purposes under and as limited by Section 13-705, Revised Ordinances of the City of Salina, Kansas, 1948: (a) Roman Candles, not to exceed 12 balls (b) Cylindrical fountains without report (includes handle, spike and base fountain) total pyrotechnic composition not to exceed ?5 grams each in weight. The inside tube diam- eter shall not exceed 3/4 inch, nor more than 62 inches in length. (c) Cone fountains and whistling fountains without report, total pyrotechnic oonposition not to exceed 50 grams each in weight. I (d) Wheels, total pyrotechnic composition not to exceed 60 grams in weight, for each driver unit, but there may be any j number od drivers on any one wheel. The inside bore of driver tubes shall not be over 2 inch. All movements must be controllable. I (e) Railway fuses -orathout spikes, truck flares, hand ship distress signals and illuminating torches, but excluding those containing magnesium. Total pyrotechnic composition of illuminating torches not to exceed 100 grams each in weight, nor more than 62 inches in length. (f) Sparklers and dipped sticks, total pyrotechnic comp- osition not to exceed 100 grams each in weight. Nor more than 2u inches in length. (g) Colored Box, Cone Fire and smoke pots, total pyrotechnic composition not to exceed 100 grams each in weight. (Does not include magnesium flares or smoke grenades). j (h) Star, Comet and floral type shells of which the mortar is an integral part, except those designed to produce an audible effect. Total pyrotechnic composition not to exceed 40 grams each in weight. (i) Mines of which the mortar is an integral part, except those designed to produce an audible effect. Total pyro- technic composition not to exceed 40 grams each in weight. (j) 1arachute shell without report, motta.r mounted on wood base, and parachute not having an attached flare. (k) Fireworks pieces that are a combination of the above approved items, (subparagraphs (a) to (j), and which are mounted on one base. Totalnumber of items on one base shall not exceed nine (9). (1) Non-poisonous snake and items of similar composition, containing no poisonous compounds. (m) Firecrackersand salutes with casings, the external dimensions of which do not exceed one and one-half inches in length by one quarter inch in diameter, designed to produce an audible effect, total pyrotechnic composition not to exceed 2 grains in wet, The sale, use and possession of all other kinds and types of fireworks, within the City of Salina, subject to the limitation aforesaid, are hereby prohibited." Section 2, That Section 13-.702, Revised Ordinances of the City of Salina, Kansas, XXt4Vz*xtX, 1948, is hereby amended to read as follows: 1 1 1113-702. SA16; LICENSE REQUIRED. It shall be unlawful for any person, firm or corporation to displyy for sale, sell or offer for sale any fireworks, including sparklers, except those specifically authorized in Section 13-701, Revised Ordinances of the City of Salina, Kansas, 1948. rrovided, as a condition precedent to the sale, selling or offering for sale of any such fireworks, than any such person, firm or corporation shall first apply for and obtain a license so to do from the City Clerk. Before any such license is issued, said applicant for such license shall pay to the City Clerk a license fee of Twenty -Five ($25.00) Dollars. Such license fee shall be due•and payable on or before the 27th day of June of each year and no license shJLU be issued after said date. A separate license shall be secured for each and every place from which the applicant for a license desires to sell fireworks, which license shall be displayed in a conspicuous place in the place of business in which such fireworks are to be sold." Section 3. That Section 13-703, Revised Ordinances of the City of Salina, Kansas, 1948, is hereby amended to read as follows: "13-703. TM WHEN SAIF rERMITTED. No fireworks shall be sold or offered for sale except from and after dine 27th to and including July 4th of each year." Section 4. That Section 13-709, Revised Ordinance of the City of Salina, Kansas, 1948, is hereby amended to read as follows: "13-709. DUTY OF rARENTS. It shall be unlawfulifor arq Parent, guardian, or other person having the care or custody of any minor, to either famish or give to such minor at any time, any of the fireworks or other articles prohibited being sold within the City of Salina, or to furnish or give to any minor any fireworks not prohibited under the provisions of Section 13-701 hereof, at any time, except upon the days when such fireworks and/or pyrotechnics are permitted to besold within the corporate limits of the City of Salina, under the provisions of this article. Section 5. That the original of Sections 13-701, 13-702, 13-703 and 13-709, Revised Ordinances of the City of Salina, Kansas, 1948, be and each ane hereby repealed. Section 6.
