AN OhDINANCE relating to and apportioning and levying special assessments on certain
lots and land and pieces of ground in the City of Salina, Kansas, to pay the cost
of construction of lateral sanitary, sewers in Lateral Sanitary, Sewer Districts
Numbered 284, 286, 287, 288, 289 and 290, and relating to and providing for the
collection and payment of such assessments.
BE IT CRUINED by the Board of Commissioners of the City of Saiina,Kansas:
Section 1. That for the purpose of paying for the cost of building and cm -

structing lateral sanitary sewers in Lateral Sanitary Sewer Districts Numbered
28.2286, 287, 288, 289 and 290, as authorized by the provisions of Ordinances

Numbered 5661, 5699, 5698, 5701, the cost of which has been duly ascertained as
shown by the City Engineer's Final Estimate of Cost, which has been duly approved
by the Board of Commissioners, there are hereby levied and assessed on the property
liable therefor, being all the lots and pieces of ground lying in the sewer districts
mentioned above as created by Ordinances Numbered 5661, 5699, 5698 and 5701, accord-
ing to the appraised value of such lots and pieces of ground without regard to

the buildings or improvements thereon, speciai assessments covering the cost of
such improvements constructed in said sewer district, saia special assessments
being based on the special valuation and a raisement made

appraisers appointed by the Board of Commissioners of the City of Salina, Kansas,
which said appraisement is hereby referred to and made a part of this ordinance,

and the several amounts levied, and apportioned against the lots and pieces of
ground in said sewer districts for the purpose of paying for the cost of 3prove-

Section 2. That for the purpose of the payment of the cost of construction

of Lateral Sanitary Sewer Number 284, an eight inch clay pipe sewer, beginning
at an existing manhole in the center of Sunrise Drive and 165 feet north of the
north line of Republic; thence northeasterly 150 feet; thence southeasterly 50 feet

where a cleanout will be constructed which will be the terminus of Lateral Number
281, the amount levied, apportioned and assessed against the lots and pieces of
ground in said district are found and determined to be as follows:

sewer beginning at
a manhole in the right-of-way of U. S. 81 By -Pass and 85 feet
south of the south
line of Franklin Street extended west; thence east 266 feet where a manhole will
be constructed on right-of-way for utilities; thence south on
said right-of-way
to the northeast corner of Lot 42, Block 5, Sunset Manor Addition; thence east
along right-of-way for utilities 240 feet to the northwest corner of Lot 2, Block
5, Sunset Manor Addition where a manhole will be constructed which will be the term-

Section 8. Said amounts levied, apportioned and assessed as aforesaid shall be
due and collectible in four equal installments, the first becoming due with the taxes
levied for the year 1953, and one of said installments falling due each arra every year
thereafter until all are paid, all to be collected with interest as in this ordinance
provided, provided however, that the owner of ary piece of property liable for any
such assessment may redeem his property from such liability by paying into the city
Treasury the entire, amount chargeable against the same as in this ordinance designated,
at any time within thirty days after the publication of this ordinance, and before the
issuance of the bonds of said city in payment of the cost of said improvements, and
his property so paid on shall not thereafter be liable for any further assessment for
the cost of said improvements nor for any part of said bonds.
Section 9. There is hereby levied and assessed furtherainst
ag such lots and
pieces of ground described in this ordinance interest at such rate per annum as shall
be borne by the bands hereafter to be issued for the
Payment of the remaining unpaid
cost of such improvements, such rate to be hereafter determined and fixed by ordinance
when such bonds are issued, on all of said installments mentioned and provided for in
this ordinance, from the date of the bonds which may be issued at the end of thirty days,
as specified in the preceding section hereof as by law provided, to the time of
collection of the last installment asrovided
P by law, which said interest shall be
collected annually at the same time and in the same manner as said installments are
collected, and after the taking effect of this ordinance and the fixing of the interest

rate when such bonds are authorized and issued, it shall be the duty of the City Clerk
of said city to annuallyat the same time other tares are certified, and until all of
j said installments so apportioned and levied herein have been certified, to
certify to the County Clerk of Saline County, Kansas, a full list of all property

a le to assessment and taxation for such work and improver nts, except such property
on which the special assessment aforesaid have been paid on full as hereinbefore
provia.ed, together with the respective amounts due on each of such lots and pieces
of ground, which amounts shall include the annual installments of such special

assessments together with the interest for one year at the rate to be fixed and pro-
vided for in this ordinance, being the rate bornei
by the bonds to be iosued on all
unpaid balances of such assessments, and such amounts so certified as herein provided
shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and
collected as ail other taxes are collected.
Section 10. This ordinance shall take effect and be in force from and after
the publication once in the official city paper.
