AN ORDINANCE relating to and apportioning and levying special assess—
ments on certain lots and pieces of ground in the City of Salina, Kansas
to pay the cost of curbing, guttering and grading of Anderson Avenue
(an the north side) from a point 200 feet west of the west line of Front
Street, to the west lin,2 of Thiry' Street and on the south side of
An-Dicrson Avenue from the west line of Front Street to the west line &f
Third Street; for the curbing, guttering and grading of Charlotte Avenue
(on the north side) from the west line of Ninth Street Place to the cen—
ter line cf Highland Avenue; and curbing, guttering and grading Charlotte
Avenue (on the south side) from the center lineof Ninth SiFrect Place to.
the center line of Highland Avenue; for the curbing, guttering and grad—

and grading of Ninth Street from the center line of Cloud Street to a
point 750 feet south of the south line of Cloud Street; for the curbing,
guttering and grading of Roach Street from the north line of iMcAdjains
Road to the south line of Martin Avenue; for the curbing, quiterine and
grading of Republic Avenue from the center line of Sunrise: Drive to 11

Sunrise Drive (on the west side) from the north line of Morningside
Drive to the south line of 'Vilson Street, and curbing, guttering and grad—
ing of Sunrise Drive (on the east side) from the north line of Morningside
Drive to the northeast corner of Lot 1, Block 6, Morningside Addition;
for the curbing, guttering and grading of Simmons Street from the center
line of Charlotte Avenue to the center line of Leslie Avenue; for the
curbing, guttering and grading of Stack Avenue from the center line of
Delaware Avenue to the east line of first alley east of Delaware Avenue;
and for the curbing, guttering and grading of 'Wisconsin Avenue from the
center line of Iron Avenue to the center line of Gypsum Avenue, and
relating to and providing for the collection and payment of such assess—
ments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section I. That for the purpose of paying for that part of fIfe
cost of improving certain portions of certain streets as hereinafter set
forth in the following sections of this ordinance which is chargeable to
the private property in the assessment district for each of such irnprc,ve—
menfs, respectively, as set forth in the following sections of this
ordinance with respect to each of such improvements., there are hereby
levied and assessed on the property liable therefor, being all of the
lots and pieces of ground lying on either side of said streets so improved,,
respectively, to the middle of the block for the distance improved, with
respect to the improvements mentioned in Sections 2, 3,4 Y 1 6 7 8
ic, 11, 12, 13 14 15 16 17 18 19 avo-doM of this ordinance according
to the appraised value of such lots and pieces of ground with respect to
each such improvement, without regard to the buildings or improvements
thereon, special assessments covering the cost of such work and lmprovz—
ments, and special assessments being based on the special valuation and
appraisement of said lots and pieces of ground heretofore rnade by three
disinterested appraisers appointed by the Board of Commissioners of the
City of Salina, Kansas, with respect to each such improvements, which

said appraisements are hereby referred to and made parts of this ordinance,

and the severals amounts levied, apportioned and assessed against theq
i
lots and pieces of ground for each of such improvements, respectively,
for the purpose aforesaid ase hereby found and determined to be the
amounts set forth in the following sections of this ordinance with respect
to each of such improvements.
Section 2. For that part of the cost of curbing, guttering and
grading of Anderson ;,venue (On the north side) from a point 200 feet
west of thewest line of Front Street, to the west line of Third Street,

Section 20. Said amounts levied, apportioned and assessed aforesaid will be due
and collectible in four equal annual installments, the first becoming due with the
taxes for the year 1953 and one of said installments falling due each and every year
thereafter until all are paid, and all to be collected with interest as in this
ordinance provided, PROMED, HOWEVER, that the owner of any piece of property liable
for any such assessment may redeem his property from such liability by pa*Ang into
the City Treasury the entire amount chargeable against the same, as in this ordinance

designated, at any time within thirty days after the publication of this ordinance
and before the issuance of bonds of said city in payment of the balance of the cost

of said improvements,and the property so paid on shall not thereafter be liable for

any further assessments for the cost of said improvements for for any part of said
bonds.
Section 21. There is hereby further levied, and assessed against each lot and
piece of ground described in this ordinance, interestat such rate per annum as shall
be borne by the bonds hereafter to be issued for the payment of the remaining cost
i
of such improvements, to be hereafter determined and fixed by ordinance when such bonds
are issued, on all of said installments mentioned and provided for in this ordinance,
from the date of the bonds which may be issued at the end of thirty days asspecificed
in the preceding sections hereof, as by law provided, to the time of the collection
of the last installment, as provided by law, which said interest shall be collected
jannually at the same time and in the same manner as said installments are collected,

j and after the taking effect of this ordinance and the fixing of said interest rate
when such bonds are authorized and issued, it shall be the duty of the City Clerk
of said city to annually at the same time other taxes a:.e certified and untilx all
certify
! of said assessments so apportioned and levied therein have been certified,/to the
County Clerk of Saline County, Kansas, a full list of all property on which the special
i
assessment and taxation for shch work and improvements is chargeable, except such
property on which the special assessments aforesaid have been paid in full as herein-
before provided, together with the respective amounts due on each of such lots and
pieces of ground, which amounts shall include the annual installments of such special
i
jassessments together with the interest for one year at the rate to be fixed as provided
for in this ordinance, on all unpaid balances of such assessments, and such amounts so
certified as herein provided for shall be placed upon the tax roll by the County Clerk
of Saline County, Kansas, and collected as othyer taxes are collected.

publication once in the official city paper.
