AN orwINANvE providing for the appropriation and condemning certain land within
the city limits of the City of Salina, Kansas, for the useof said city for the
drilling and erection of two water wells to be used to supply said city and its
inhabitants with water.
WHERmAS, the governing body of the City of Salina, Kansas, on April 6, 1953, by
Resolution Number 1393 found it necessary to appropriate certain private property
in Salina, Saline County, Kansas, as described in said resolution for the use of
said city for the drilling and erection of water wells to be used to supply said
city and its inhabitants with water and directing that a survey and description
of said land so acquired be made.
WH&LeAS, on the 6th day of April, 1953, a survey and description of the land so
required was duly filed, so now therefore, and, so now,
BE IT Om AMM by the Board of Cdamissioners of the City of Salina, Kansas:
Section 1. The following described land is hereby condemned and appropriated
for the use of the City of Salina, Kansas, for the drilling and erection of water
wells to be used to supply said city and its inhabitants with water, to -wit:
Tract 1. The East Fifty (50) feet of the South Fif*
(50) feet of Lot 8 in Atherton -Phillips Addition to
the City of Salina, Saline County, Kansas; and
Tract 2. The South Fiftit (50) feet of the east Half
(EJ4 of Lot 2 in Geis Addition to the City of Salina,
Saline County, Kansas;
Section 2. That C. L. Clark, City Attorney, is hereby ordered and directed
to forthwith prepare and present in the nage of the Board of Commissioners of the
City of Salina, Kansas, a written application to the Judge of the District Court
of Saline County, Kansas, praying for an order of appointment of commissioners to
make appraisement and assessment of damages arising from the appropriation of said
real estate described in Section 1 hereof, and do and perform all things in and
about the procuring and recording of said order of appointment required by law, and
completing the appropriation of said land as provided by law.
Section 3. This ordinanceshall takeeffect and be in force .from and after its
publication in the official city paper.
