AN ORDINANCE creating and defining a certain Main Sewer district in
the City of Salina, Kansas, designated as Main Sanitary Sewer "AB"
and providing for the construction of a Whin Sanitary sewer in said
Main Sewer Distret "AB", so created, and providing for the payment of
the cost thereof and for the levying of special assessments against
the property in said district for the payment of the cost of such con—
struction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

Section I. Main Sewer District "AB". That there be and there
is hereby created Main Sewer District in the City of Salina, Kansas,

which shall be and it is hereby designated as Main Sewer District ''A B"
and which district shall include the following described property

in the City of Salina, Kansas, to—wit:
Lots 2, 4, 6, 8, 10, 12, 14
and 16 of Block
2, all of Blocks 3 and 4, Lots 2, 4, 6, 8,
10, 12 and 14 of Block 8, and all of Block

Section 2. It is necessary and it is hereby ordered that an

eight inch V. C. P. main sewer with all necessary connections, manholes,
be constructed and built in and
i flushing tanks and other appurtenances

to sdrve said Main Sewer District "A B" as created by Section I of this
ordinance along the following course, to—wit:
An 8 inch clay pipe sewer beginning at a man—
hole to be built over an existing 10 inch pipe
sewer 19 feet south of the center line of North
Street and in the center of the alley between
Thirteenth Street and Reynolds Street thence
west, parallel to the center line of forth
Street 940 feet to a manhole which will be con—
structed, which will be the terminus of Main
Sewer nABrr
Section 3. That the City Engineer shall on or before the 13th
day of April, 1953, prepare and file in the office of the City Clerk,
plans and specifications for the construction of the main sewer pro—

vided for in the preceding sections of this ordinance which shall be
of the proper character to serve the property lying within the district
for which such sewer is to be constructed and shall on or before the
same date prepare and submit to the Board of Commissioners a detailed
estimate under oath of the cost thereof. That thereafter the City
Clerk zzlxi shall advertise for three consecutive days in the official
city paper for sealed proposals for the building and construction of
such sewer acoording to such plans and specifications, which proposals
shall be filed with the City Clerk on or before the time fixed in such
notice, at which time the Board of Commissioners may let a contract
for the building and construction of such sewer to the lwwest and best
responsible bidder or bidders thereof; if there be any whose bids do
not exceed the estimated cost thereof, but said Board shall reserve
the right to reject any or all such proposals, and if no bid shall be

received within such estimate, the Board of Commissioners shall have
the power to do such work and make such improvements within the esti-
mated cost thereof as provided by law.
Section 4. That for the cost of building and constructing such
sewer, special assessments shall be made for the fu 11 cost thereof as
on all lots and pieces of land within and for which such sewer shall
be built according to the appraised value thereof, without regard to the
impmovements or buildings thereon.
Section 5. After the passage and publication of this ordinance,
the Board of k Commissioners shall appoint three disinterested appraisers,
who after having taken oath to make a true and impartial appraisement
of all lots and pieces of land to taxation for the cost of such improve-
ments, shall within five days after having been notified of their appoint-
ments proceed to appraise all of the lots and pieces of land Within
such district liable to assessment and taxation as aforesaid, without
regard to the buildings or improvements thereon, and after having made
to
such appraisements, shall return the Board of Commissioners of said city
and said Board shall designate a time for a special meeting of said
Board for the purpose of hearing any complaints that may be made as
to the value of any lot or piece of land appraised as aforesaid, of
which special session due notice shall be given in the official city
paper, at which special session said Board may alter any valuation of
any lot or piece of land, if, in their opinion, the :same has been
appraised too high or too low.
Section 6. The special assessment herein provided for may be
paid by the person liable in four approximately equal annual install-
ments but the owner of any property liable to such assessment may within
thirty days from the date of determining the amount assessed against
the property, pay the same in full and his property sahll not be liable
for any assessments for the cost of such improvements, and bonds as
hereinafter provided for shall be issued in the amount of the cost of
such improvements remaining unpaid at the end of thirty days from the
time such assessment is fixed.
Section 7.. For the purpose of paying for the work and improve -
ami ments in this ordinance provided for the B®rd of Commissioners may
and are hereby authorized and directed to issue improvement bonds of
the City of Salina, Kansas, in an amount not to eilceed the cost of
such improvements, and to run for a period of four years and be payable
in four approximately equal annual installments, together with interest
not to exceed five per cent per annum, which bonds shall be issued and
payable according to law, and for the purpose of paying the principal

and interest on said bonds as they severally become due and payable
for the Board of Commissioners shall apportion and assess against the

lots and pieces of land within the taxing district for such improvements,
special assessments covering the cost of such improvem?nt and apportion—
ment therein contained shall hold good for all of the installments
that are to be collected from the specific property chargeable; such
assessment and apportionment ordinance shall contain the total amount
of tax apportioned to such tract, piece or parcel of land within the
taxing district and shall state the number of annual installments in
which such tax is to be collected; and thereafter the City Clerk shall
annually, at the same time t:i^t other taxes are certifidd, certify
to the County Clerk of Saline County, Kansas, a full list of all
property liable for such work and improvers ntsl, together with the
respective amounts due on each of said tracts, pieces or parcels of
land, which amounts ah shall include the annual installment and interest
on all unpaid balancesfor one year at the rate of not to exceed five
per cent per annum, on such amounts so certified, wlafioch which shall
be collected as other taxes are collected.
Section 8. Thi; ordinance shall take effect and be in force from
and after its publication once in the offit,dal official city paper.
