AN ORDINANCE ratifying and confirming a contract with 0. D. Wiimoth
Construction Company for the construction of a certain storm sewer
in the City of Salina, Kansas, heretofore designated as Franklin Street
Storm Sewer, and providing for the issuance of temporary notes to pay
the cost thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Ckommissioners of the City of Salina,
Kansas
Section I. That the acceptance of the City of Salina, Kansas, of
the proposal of the O. D. Wilmoth Construction Company, hereinafter
referred to as the "contractor", as submitted to the Board of Commi—
ssioners on March 301 1953, which is hereby found to be the lowest and
best bid for such work, and the contract awarded by the Board of Commi—
ssioners of said city to said contractor and signed on behalf of the
City by its Mayor on April 6, 19533, for the construction of certain pub—
lic improvements in the City of Salina, Kansas, to—wit:

MAIN SEWER: A 36" inch concrete pipe sewer
eginn ng at a manhole at the intersection of
Osage Avenue and Franklin Street, thence east
In Franklin Street, 293 feet, more or less, to
the intersection of Franklin Street and 114ohawk
Avenue, thence east in Franklin Street, with
a 30" inch concrete pipe sewer 274 feet, more
or less, to the intersection of Seminole Avenue
and Franklin Street.
Lateral No. I. Beginning at the intersection
of Mohawk Avenue and Franklin Street, thence
south in Mohawk Avenue with a 12 inch concrete
pipe sewer 430 feet where a manhole will be con—
structed which will be the terminus of Lateral
Number I.
Lateral No. 2. Beginning at the intersection of
Franklin Street and Seminole Avenue, thence south
in Seminole Avenue with an 18 inch concrete pipe
sewer 919 feet, more or less, to the intersection
of Seminole Avenue and Shawnee Avenue where a
manhole will be constructed which will be the
terminus of Lateral Number 2
at and for the unit price for said work contained in said proposal,
which proposal and contract are hereby referred to and made a part of
this ordinance, be and the same is hereby ratified and confirmed, said
proposal being within the estimate cost of said improvements as shown
by the sworn estimate of the City Engineer on file in the office of the
City Cler, which estimate is hereby referred to and made a part of this
ordinance.
Section 2. Said improvements shall be built and constructed in
accordance with the plans and specifications therefore prepared by the
City Engineer on file in the office of the City Clerk and in accordance
with the proposal of said contractor and under the terms of said contract,
all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested
by the City Clerk be issued from time to time as the work progress4s
in the manner and form as required by law, the total amount thereof not
to exceed the contract price of $19,082.25 for such work, such notes to

bear interest at not to exceed 41 per cent per annum and to mature not
later than December 1, 1954, and to be issued in such amounts and at such
times as may the money for the payment of the cost of such work be
required, such notes to be issued to said contractor and to be redeemed
and cancelled at the time that Internal Improvement Bonds are issued
in lieu thereof.
Section 4. That this ordinance shall take effect and be in full
force from and after its publication once in the official city paper.
