5762 Utility Improvements - Franklin StreetORDINANCE NUMBER 5762 953) (Published in the Salina Journal r+�tC (3 , 7 --_ AN ORDINANCE providing for the construction of a certain storm sewer and drainage in the City of Salina, Kansas to be designated as Franklin Street Storm Sewer, and providing for the letting of contract for such construction and for the pay- ment of the cost thereof. WHEREAS, at all times heretofore, the entire City of Salina has constituted a storm sewer and drainage district and bonds issued to pay the cost thereof are payable by a general tax as provided by law; and BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: i Section 1. That the preamble of this ordinance is hereby incorporated herein. That the entire City of Salina is hereby determined to be the benefit district j for the purpose of the installation of a system of storm sewerage and drainage in I the said city. That the entire limits of said city has always constituted one district for said purpose. i, Section 2. That it is necessary and it is hereby, ordered that a storm sewer li (described as a main sewer and certain laterals for convenience only), which is hereby designated as Franklin Street Storm Sewer, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to -wit: I MAIN SEWER: A 3611 inch concrete pipe sewer beginning at a manhole at the intersection of Osage Avenue and Franklin Street, thence east in Franklin Street, 293 feet, more or less, to j the intersection of Franklin Street and Mohawk Avenue, thence east in Franklin Street, with a 3011 inch concrete pipe sewer 274 feet, more or less, to the intersection of Seminole Avenue and Franklin Street. Lateral No. 1. Beginning at the intersection of Mohawk Avenue and Franklin Street, thence south in Mohawk Avenue with a 12 inch concrete pipe sewer 430 feet where a manhole will be constructed, which will be the terminus of Lateral Number 1. Lateral No. 2. Beginning at the intersection of Franklin Street and Seminole Avenue, thence south in Seminole Avenue with an 18 inch concrete pipe sewer 919 feet, more or less, to the intersection of Seminole Avenue and Shawnee Avenue where a manhole will be constructed which will be the term- inus of Lateral Number 2. i Section 3. That on or before the 16t day of ka.rch , 1953, the City Engineer shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewers provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such types of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewers and at the time and place mentioned, the Board of Commissioners mW let a contract with the lowest and best responsible bidder therefor for the couso IF, ATED— L, T, I I 1 building and construction of such storm and drainage sewers, but the right to reject any and all bids shall be and is hereby reserved, and provided further that if no responsible person shall pbrpoBe to enter a contract at a price not exceeding the estimated cost., then the Board of Commissioners may proceed to construct said improvements within the estimated cost thereof and shall purchase the necessary tools, apparatus., and materials and employ the necessary labor for the purpose of constructing the same. Section 4. That for the payment of the cost of said work., the Board of Commissioners shall issue General Obligation and Improvement Bonds of the City of Salina Kansas in an amount not to exceed the Jdm total cost of such work and improvements., to be payable in 4 approximately equal annual install- ments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature., the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina in an amount sufficient to pay the annual installments of such principal and interest., and that pending the issuance of such bonds., temporary notes shall be issued according to law,, to pay the cost of such work.
