TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made this J1. day of August, 2006, by and THOMAS M.
CHRISTY and LEE A. CHRISTY, husband and wife, (the "Grantor") and the CITY OF
SALINA, KANSAS, a municipal corporation, (the "City").
WITNESSETH: The Grantor donates and conveys to the City, a temporary construction
easement in, through, over, and across a certain portion of land owned by the Grantor, as legally
described and depicted on the attached and incorporated Exhibit A (the "Temporary Easement")
for all rights of ingress and egress of the City, its employees, and its contractors for the purposes
of access and surface reshaping or regrading, for a term commencing with the date of this
indenture and terminating upon the earlier of one (1) year from the date of this indenture or
completion of construction of the North Broadway Improvement Project (the "Project").
By acceptance of this Indenture, the City covenants that:
A.
The area of Grantor's property disturbed during the term ofthe Temporary
Easement will be fully restored to a graded and seeded condition at the
end of the term ofthe Temporary Easement; and
B.
Grantor's concrete parking lot partially crossed by the Temporary
Easement shall neither be disturbed nor damaged in the course of
completing the Project. If inadvertently damaged during construction of
the Project, the concrete parking lot shall be fully restored at no cost to
Grantor.
IN WITNESS WHEREOF, the Grantor has signed this Temporary Construction
Easement the day and year first above written.
