91-9480 Vac Wallerius 2Kunn Cor Priming — Safina, Kansas (Published in The Salina Journal , 1991 ) ORDINANCE NUMBER 91-9480 AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN UTILITY EASEMENTS AND TEMPORARY STORM WATER DRAINAGE EASEMENT IN WALLERIUS ADDITION NUMBER 2. Kansas: BE IT ORDAINED by the Governing Body of the City of Salina, Section 1. That the certain storm water drainage easement on Lot Nine (9) , Block One (1) , Wallerius Addition Number Two and the certain twenty foot (201) utility easement on Lots One (1) through Seven (7) , Block One (1) , Wallerius Addition Number Two (2) , to the City of Salina, Saline County, Kansas, be and the same are hereby vacated, subject to the following conditions: 1. The petitioner shall dedicate a permanent storm drainage easement on a portion of Lots Eight (8) and Nine (9) , Wallerius Addition Number Two (2) as follows: Part of Lot One (1) , Block Four (4) , and Lot Eighteen (18) , Block Three (3) , Southwestern Mobile Home Court Planned Development District to the City of Salina, Saline County, Kansas, also known as that part of Lots Eight (8) and Nine (9) , Block One (1) , Wallerius Addition Number Two to the City of Salina, Saline County, Kansas, described as follows: Lot Nine (9) , Beginning at the southeast corner of said Lot Nine (9); Thence North eighty-seven degrees twenty-two minutes zero seconds West (N.87022100"W.) along the south line of said lot a distance of forty and four hundredths feet (40.041) to the point of beginning; Thence North eighty-seven degrees twenty-two minutes zero seconds West (N.87°22100"W.) along said south line a distance of eighty and forty-eight hundredths feet (80.48'); Thence North zero degrees zero minutes zero seconds West (N.00000100"W.) a distance of two hundred fifty-two and one hundredth feet (252.011) to the north line of said lot; Thence South eighty-nine degrees fifty-one minutes zero seconds East (S.89°51100"E.) along said north line a distance of eighty and seventeen hundredths feet (80.17') to the northeast corner of said lot; Thence South zero degrees three minutes zero seconds East (S . 00°03'00"E .) along the east line and extended east line of said lot a distance of two hundred fifty-five and forty-nine hundredths feet (255.491) to the point of beginning; BE and Lot Eight (8) : Beginning at the southeast corner of said Lot Eight (8); Thence north eighty-nine degrees fifty-one minutes zero seconds West (N.89051'00"W.) along the south line of said lot a distance of eighty and seventeen hundredths feet (80.17'); Thence North zero degrees zero minutes zero seconds West (N.00000100"W.) a distance of seventy-five feet (751); Thence South eighty-nine degrees fifty-one minutes zero seconds East (S.89051100"E.) a distance of eighty and ten hundredths feet (80.10') to the east line of said lot; Thence South zero degrees three minutes zero seconds East (S . 00°03'00"E .) along said east line a distance of seventy-five feet. (75') to the point of beginning. The above combined parcels of land contain 26, 381.38 square feet, more or less. 2. The petitioner shall submit a maintenance agreement to the City of Salina causing the petitioner to be totally responsible for construction and maintenance of the proposed storm water detention basin. 3. The petitioner shall provide written agreements with KPL Gas Service and Southwestern Bell Telephone Company to allow relocation of existing utilities in the proposed vacated easements at a total cost to the petitioner. 4. The petitioner shall dedicate new ten foot (101) utility easements in the PDD for use by any franchise utility company. 5. The ordinance vacating these easements shall not be published until conditions one (1) through four (4) have been complied with and a revised/ corrected development plan drawing for the Southwestern Mobile Home Court has been recorded in the Saline County Register of Deed's Office. Section 2. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
