93-9548 Vac Orig TownKuhn -Cox P (.l g — Saline, K,—, (Published in The Salina Journal January 1993) ORDINANCE NUMBER 93-9548 AN ORDINANCE PROVIDING FOR THE VACATION OF A CERTAIN PORTION OF THIRD STREET IN THE ORIGINAL TOWNSITE OF THE CITY OF SALINA, SALINE COUNTY, KANSAS. Kansas: BE IT ORDAINED by the Governing Body of the City of Salina, Section 1. That Third Street, a platted public street in the Original Townsite of the City of Salina, Saline County, Kansas, from the North right-of-way line of Elm Street North to a line which is forty (40) feet southeasterly of the centerline of the connecting wye track between the Union Pacific Railroad Company's Track Number Seventy-one (71) and the Missouri Pacific Railroad Company's Track Number Ten (10) , adjacent to part of Lot Twenty-six (26) , all of Lots Twenty-eight (28) , Thirty (30) , Thirty-two (32) , Thirty-four (34) , Thirty-six (36) , Thirty-eight (38) , Forty (40) , Forty-two (42), Forty-four (44), Forty-six (46), Forty-eight (48) on Third Street, Lot Ten (10) on Elm Street and the County Park north of Lots Six (6) , Seven (7) , Eight (8) , Nine (9) and Ten (10) on Elm Street, all in the Original Townsite of the City of Salina, Saline County, Kansas, is hereby vacated; PROVIDED, HOWEVER, the City retains a utility easement described as follows: The West thirty (30) feet of the east forty (40) feet of the vacated Third Street right-of-way extending from the North right-of-way line of Elm Street north to a line which is forty (40) feet southeasterly of the centerline of the connecting wye track between the Union Pacific Railroad Company's Track Number seventy-one (71) and the Missouri Pacific Railroad Company's Track Number ten (10) . Section 2. That the property vacated herein revert to the adjacent property in accordance with K.S.A. 13-443. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
