ORDINANCE NUMBER 92-9539
AN ORDINANCE PROVIDING FOR THE VACATION OF THE SIXTEEN
FEET (16') BY ONE HUNDRED FIFTY FEET (150') EAST -WEST ALLEY LOCATED
BETWEEN JEWELL AND KIRWIN AVENUES, NINTH STREET AND HIGHLAND
AVENUE IN THE GROUNDS OF KANSAS WESLEYAN ADDITION TO THE CITY
OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas
Section 1. That the sixteen feet (161) by one hundred fifty feet
(150') east -west alley located between Jewell and Kirwin Avenues, Ninth Street
and Highland Avenue in the Grounds of Kansas Wesleyan Addition to the City
of Salina, Saline County, Kansas, be and the same is hereby vacated with the
following conditions:
I. That a sixteen feet (16') by one hundred fifty feet
(150') utility easement is retained over the entire
alley which allows access to the area by the City and
all franchise utilities. No permanent structures
shall be constructed in the easement.
2. That reciprocal access easements must be granted by
the adjoining property owners (currently the
Robertsons and the Moyers) to provide for vehicular
access to existing garages. The easements must be
recorded with the office of the Saline County Register
of Deeds and shall not be released without the consent
of the City.
Section 2. That the above described alley, which is vacated by
this ordinance, shall revert to the adjacent property owner in accordance with
K.S.A. 13-443.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
