ORDINANCE NUMBER 92-9516
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION
OF A CERTAIN NORTH -SOUTH ALLEY BETWEEN SANTA FE AVENUE AND
FOURTH STREET AND BETWEEN BELOIT AND MINNEAPOLIS AVENUES IN THE
GROUNDS OF KANSAS WESLEYAN UNIVERSITY ADDITION TO THE CITY OF
SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas
Section 1. That the south half of the certain north -south alley
between Santa Fe Avenue and Fourth Street and between Beloit and Minneapolis
Avenues adjacent to Lots Twenty (20) , Twenty-two (22) , and Twenty-four
(24) , Santa
Fe Avenue and
Lot Twenty-two (22) ,
Minneapolis
Avenue
in the
Grounds of
Kansas Wesleyan
University Addition to
the City of
Salina,
Saline
County, Kansas, is hereby vacated; provided, however, that the fifteen (15)
foot by one hundred twenty (120) foot alley right-of-way be retained as a
utility easement.
Section 2. That the alley shall be vacated with the following
conditions:
1. The existing alley approach on Minneapolis Avenue shall be
removed and replaced with full -depth curb and gutter within
sixty (60) days of the effective date of this ordinance. The
property owners may choose to rebuild their driveways on their
own lots.
2. The north entrance to the alley shall be blocked either by
fencing or landscaping within sixty (60) days of the effective
date of this ordinance.
Section 3. That the alley vacated hereby shall revert to the
adjacent property owners in accordance with K.S.A. 13-443.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
