Kansas (Published in The Salina Journal May 1992) ORDINANCE NUMBER 92-9506 AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY THE QUESTION OF IMPOSING A ONE-HALF PERCENT (1/2%) RETAILERS' SALES TAX COMMENCING JANUARY 1, 1993, IN THE CITY OF SALINA, KANSAS. WHEREAS, K.S.A. 1984 Supp. 12-187 et seq., as amended, authorizes the Governing Body to submit to the qualified electors of the City the question of levying a retailer's sales tax, such tax to be collected by the State Department of Revenue with the revenue therefrom returned to this City; and WHEREAS, the Governing Body of the City of Salina, Kansas has determined that additional revenue is needed to provide an adequate level of public services within the City, that additional revenue is needed to provide important capital improvements, that property tax increases should be avoided if possible and that the voters should be given a choice as to the method used to finance public services; SO NOW, THEREFORE Kansas: BE IT ORDAINED by the Governing Body of the City of Salina, Section 1. Pursuant to K.S.A. 12-187 et seq., the Governing Body submits the following question: SHALL THE CITY OF SALINA, KANSAS, IMPOSE A HALF -PERCENT (1/2%) RETAILERS' SALES TAX BEGINNING JANUARY 1, 1993? to the electors of the City at the county primary election on August 4, 1992 (or such other date as the 1992 county primary election may be scheduled) . Section 2. If a majority of the electors voting on the proposition at the county primary election approve the levy of the tax, the governing body shall provide by ordinance for the levy of the tax. Section 3. If approved, the tax shall be subject to all applicable state laws and administrative rules and regulations of the Kansas Department of Revenue. The services of the Kansas Department of Revenue shall be utilized to administer, enforce and collect such tax. Section 4. Pursuant to K.S.A. 12-191, if approved, the collection of such tax shall commence on the first day of the calendar quarter next following the sixtieth (60th) day after the date of the election authorizing the levy of the tax, which is January 1, 1993. Section 5. The City Clerk is directed to request that the County Election Officer take all steps necessary to include the proposition set forth in Section 1 above on the ballot for the 1992 county primary election, including publication of the notice of the election pursuant to K.S.A. 12-187 and 10-120. The notice shall be published in the official city newspaper once each week for two consecutive weeks, with the first publication to be not less than twenty-one (21) days prior to the election. The notice shall set forth the time and place of the election and the proposition to be determined. Kinn -Co. P-11, — Sallna. Kansas Section 6.
