ORDINANCE NUMBER 93-9607
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas
Section 1. AMENDMENT. DISTRICT "PDD". PLANNED
DEVELOPMENT DISTRICT. That the Zoning District Map of the City of
Salina, Kansas, duly adopted and published as a part of Ordinance Number
8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:
Lots One (1) through Four (4) , Block One (1) , McArthur
Park Addition to the City of Salina, Saline County, Kansas.
shall become a part of District "PDD". PLANNED DEVELOPMENT DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT
DISTRICT. Development of the property shall be subject to the plans on file
with the City Planning Commission and/or City Clerk and the following
conditions, to -wit:
1. All lots shall be subject to the permitted uses, lot
size and bulk regulations specified in the R Single
Family Residential District.
2. A final plat shall be submitted and approved prior to
final approval of the preliminary planned development
district.
3. The City
Engineer shall approve plans
and
specifications
for the storm water
collection
and
detention system
prior to issuance
of any building
permits for
Lots One (1), Two (2)
and Three
(3);
construction
shall be completed prior
to issuance
of a
certificate of
occupancy.
4. The applicant shall provide legal assurances to the
city obligating all lot owners to participate in the
cost of widening McArthur Lane. Said assurances
shall take the form of a covenant legally binding
existing and future owners of land within the
development. This covenant shall be recorded with
the final plat. McArthur Lane shall be widened to
twenty (20) feet of paving with curb and gutter where
appropriate prior to the issuance of a building permit
for a second new dwelling; provided however, a

twenty foot (201) wide turnout shall be constructed
prior to any new homes being constructed.
5. The preliminary plan/plat drawing shall be revised to
show the location and extent of the proposed future
widening of McArthur Lane and proposed drainage
detention pond easement.
6. The applicant shall submit a revised preliminary
development plan/plat containing all noted corrections
prior to consideration by the city Commission.
7. The proposed sewer line shall be located and installed
so as to preserve the existing tree line along the
south property line.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
