Priming — Salina, Kansas (Published in The Salina Journal August 31, 1993) ORDINANCE NUMBER 93-9592 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -5". PLANNED SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: A tract of land located in the Northeast Quarter (NE/4) of Section Thirty-four (34), Township Fourteen South (T14S), Range Three West (R3W) of the Sixth Principal Meridian, being a portion of Block Twenty-four (24) of the Schilling Subdivision of the City of Salina, Saline County Kansas, more particularly described as follows: Commencing at the northeast corner of the Northeast Quarter (NE/4) of said Section Thirty-four (34); Thence on an assumed bearing of North eighty-nine degrees forty-six minutes twenty-three seconds West (N89°46'23"W. ) along the North line of said Section Thirty-four (34) a distance of seven hundred seventy-four and two hundredths feet (774.02') ; Thence South zero degrees six minutes twenty-four seconds East (5.00°06'24"E.) a distance of twelve and thirty-eight hundredths feet (12.381) to a point on the East right-of-way line of Centennial Road and the South right-of-way line of Magnolia Road, the same being the TRUE POINT OF BEGINNING; Thence South eighty-eight degrees twenty-seven minutes eighteen seconds East (588'27'18"E.) along the same South right-of-way line of Magnolia Road a distance of two hundred forty-seven and forty-one hundredths feet (247.411) to the intersection of the channel easement and the aforementioned Magnolia Road easement recorded in Book 95, Page 586, with the Register of Deeds in Saline County, Kansas; Thence South one degree thirty-two minutes forty-six seconds West (SOI°32'46"W.) a distance of thirty-seven and seven hundredths feet (37.07') along the same aforementioned channel easement; Thence South fifty-one degrees fifty-seven minutes fifty-six seconds West (S51°57'56"W.) a distance of three hundred twelve and seventeen hundredths feet (312.17') to a point on the east right-of-way line of Centennial Road; Thence North zero degrees six minutes twenty-four seconds West (N00'06'24"W.) along the same east right-of-way line a distance of two hundred thirty-six and seven hundredths feet (236.07') to the TRUE POINT OF BEGINNING. The above described tract contains 0.772 acres, more or less. shall become a part of District "PC -5". DISTRICT. PLANNED SERVICE COMMERCIAL Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED SERVICE COMMERCIAL DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. Proposed trees shall comply with city guidelines for type and size; 2. The trash dumpster shall be enclosed with a wall or solid fence; 3. Permitted uses shall be limited to a convenience store with gasoline sales plus any other use permitted in the C-3 district; 4. Development shall be completed in substantial conformance with the site plan and associated submittals. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
