ORDINANCE NUMBER 93-9586
AN ORDINANCE PROVIDING FOR THE VACATION OF A CERTAIN
PORTION OF SHADY BEND DRIVE IN THE REPLAT OF MOOSE ADDITION TO
THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That a certain portion of Shady Bend Drive, a platted
public street in the Replat of Moose Addition to the City of Salina, Saline
County, Kansas, more particularly described as follows:
Commencing at the southeast corner of Lot Thirteen (13) ,
Block Five (5) , Replat of Moose Addition;
Thence on an assumed bearing of South ninety degrees zero
minutes and zero seconds West (S .90°00'00"W.) along the
south line of said Lot Thirteen (13) , one hundred ten feet
(110') to the point of beginning;
Thence South zero degrees zero minutes and zero minutes
West (S.00°00100"W.) sixty feet (60.00') to a point on the
north line of Lot Five (5) , Block Six (6) , in said
addition;
Thence North ninety degrees zero minutes zero seconds
East (N . 90'00'00"E .) along the north line of said Lot Five
(5) , fifteen feet (15.00') , said point being fifteen feet
(15.00') west of the northeast corner thereof;
Thence North fourteen degrees two minutes ten seconds
West (N.14°02'10"W.) sixty-one and eighty-five hundredths
feet (61.85') back to the point of beginning.
The above described tract contains four hundred fifty
(450.00) square feet.
is hereby vacated; PROVIDED, HOWEVER, the City imposes the following
conditions:
1. The Shady Bend Drive "hammerhead" (vehicle
turn -around) shall be replaced according to City
specifications at the full cost to the Summit Group
within ninety (90) days of the adoption and
publication of this vacating ordinance.
2. The City barricades shall be removed and replaced to
reflect the new street limits at the full cost to the
Summit Group.
3. The Comfort Inn will no longer have direct access to
its trash dumpsters from the end of Shady Bend
Drive.
Section 2. That the property vacated herein revert to the adjacent
property in accordance with K.S.A. 13-443.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
