Kansas (Published in The Salina Journal June 1993) ORDINANCE NUMBER 93-9572 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF; AND REPEALING ORDINANCE NUMBER 8505. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas Section 1. AMENDMENT. DISTRICT "PDD". PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots One (1) and Two (2) , except the North one hundred five feet (105') , Three (3) , Four (4) , Five (5) , Six (6) , Seven (7) , Eight (8) , Nine (9) , Ten (10) , Block Eight (8) , Georgetown Addition to the City of Salina, Saline County, Kansas. (Tracts #1-3) shall become a part of District "PDD". PLANNED DEVELOPMENT DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property in Section 1 above shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: A. That the only uses permitted on said property shall be as follows: (1) Apparel Stores; (2) Banks and Financial Institutions; (3) Barber and Beauty Shops; (4) Business and Professional Offices; (5) Dry Cleaning and Laundry Receiving (no processing) ; (6) Foodstores (Grocery, Meat, Bakery, Delicatessens); (7) Gasoline (self-service); (8) Gift, Variety & Florist; (9) Hardware; K,h,-C , Printing — Salina, Kansas (10) Package Liquor; (11) Pharmacy; (12) Restaurants and Private Clubs; and (13) Photography Studios. B . That said property be developed in accordance with the architectural renderings presented with the preliminary development plan of said PLANNED DEVELOPMENT DISTRICT. C. That the final plans and the buildings as constructed in the PLANNED DEVELOPMENT DISTRICT contain the wood beams, brick construction, brick sidewalks, attractive lighting, both indoor and outdoors, shrubs and plantings, and sufficient green areas surrounding the buildings so as to be an asset to the area, said construction and landscaping to be within 5% of the proposed development plans. Section 3. AMENDMENT. DISTRICT "PDD (R-2)". PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: North one hundred five feet (1051) of Lots One (1) and Two (2) , Block Eight (8) , Georgetown Addition to the City of Salina, Saline County, Kansas. (Tracts #4-8) shall become a part of District "PDD (R-2)". PLANNED DEVELOPMENT DISTRICT. Section 4. CONDITIONS OF APPROVAL. That the use of said described property in Section 3 above shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "R-2", MULTIPLE FAMILY RESIDENTIAL DISTRICT and the following conditions, to -wit: 1. The development plan shall be amended to show a twenty foot (20') rear yard building setback on Tracts Five (5) through Seven (7) . 2. A twenty foot (20') utility easement along the property line between residential and commercial tracts shall be dedicated by separate instrument or a private sewer line agreement approved as to form by the Zoning Administrator shall be recorded prior to the issuance of any building permits. 3. Two (2) mylar copies of the amended final development plan containing all required technical corrections shall be prepared and submitted to the Zoning Administrator for review and an approved mylar copy of the final development plan shall be recorded in the Register of Deeds office prior to issuance of any building permits. A vegetative hedge or six foot (6') solid fence shall be installed along the property line between Tracts Four (4), Five (5), Six (6), Seven (7), Eight (8), and Tract Three (3) at the time a building permit is issued for any commercial buildings on Tract Three (3). Section 5. That Ordinance Number 8505 is hereby repealed. Section 6. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
