93-9561 Zone Weaver & Bishop(Published in The Salina Journal September.U, 1993) ORDINANCE NUMBER 93-9561 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PDD / R-3" . PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots One (1) through Six (6) , Elm Street, Weaver's Addition Lots One (1) through Six (6) , Park Street, Weaver's Addition Lots Eighteen (18) through Thirty-seven (37) , Bishop's Third Addition all in the City of Salina, Saline County, Kansas. shall become a part of District "PDD / R-3" . PLANNED DEVELOPMENT DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. The landscaping plan shall be amended to show: a. Substitution of the Aristocrat Pear for Bradford Pear on the planting list. b. The addition of low growing shrubs on the 4' berm along the south face of the jail building, on the 4' berm between the parking lot driveways on Twelfth Street and on the 4' berm between the driveways on Elm Street. C. Lowering or removal of the 4' berm at the southwest corner of Elm and Eleventh Streets. Kuhn -C— P-1— — Salina. Kansas d. The addition of plantings on the street parking and islands adjacent to the parking lot south of the Law Enforcement Center. 2. The existing 18" storm sewer in Eleventh Street shall either be abandoned and relocated or encased in a steel sleeve in accordance with the specifications established by the Director of Engineering and Utilities. 3. The applicant shall replat the property or a separate petition for the vacation of Eleventh Street and the alley between Eleventh and Twelfth Streets shall be approved by the City Commission prior to final zoning approval. 4. No building permits for the jail site shall be issued until such time as the Director of Engineering and Utilities certifies that the public water system is capable of supplying 1,500 g . p . m . to the site. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
