AN ORDINANCE PROVIDING FOR THE VACATION OF A SIXTY FOOT
PUBLIC RIGHT-OF-WAY LOCATED ALONG THE WEST LINE OF THE SOUTHEAST
QUARTER OF SECTION 19, TOWNSHIP 14 SOUTH, RANGE 2 WEST IN THE CITY OF

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
s Section 1. That on July 24, 2006, the governing body conducted a public hearing on the
petition filed by John Ludes Jr. and Dona Ludes ("Petitioner") requesting vacation of a 60 -foot public
right-of-way located along the west line of the Southeast Quarter of Section 19, Township 14 South,
Range 2 West in the City of Salina, Saline County, Kansas and more particularly described and shown
on Exhibits "A" and `B".
that:
Section 2. That the governing body finds from the evidence presented at the public hearing
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by the vacation of the
alley.
(c) In justice to the Petitioner right-of-way vacation request should be
granted.
Section 3. That the right-of-way located along the west line of the Southeast Quarter of
Section 19, Township 14 South, Range 2 West as described in Exhibit "A" is hereby vacated and shall
revert back to the property owner.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.

Vacation of a Public Right -of -Way for public street purposes over and
across the following described property.
The vacation of a Public Right -of -Way, recorded in the Saline County
Register of Deeds Book 393, Page 329, located in the Southeast Quarter of
Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West
of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas, .
more particularly described as follows:
The West Sixty (60) feet of the South One Hundred Ninety -Two (192)
feet of the North Half of the South Half of the Southeast Quarter (N/2 S/2
SE/4) and the North Thirty -Three feet of the South -Half of the South Half of
the Southeast Quarter (S/2 S/2 SE/4), all in Section Nineteen (19), Township
Fourteen (14) South Range Two (2) West of the Sixth Principal Meridian,
Saline County, Kansas, Lying West of the Salina'Flood Control Dike.
