ORDINANCE NUMBER 06-10341
AN ORDINANCE PROVIDING FOR THE VACATION OF AN EIGHTY FOOT
(80') UTILITY EASEMENT LOCATED IN THE VACATED RIGHT-OF-WAY OF EIGHTH
STREET AND AN EIGHTY FOOT (80') UTILITY EASEMENT LOCATED IN THE
VACATED RIGHT-OF-WAY OF TEAGUE AVENUE IN THE CITY OF SALINA, SALINE
COUNTY, KANSAS.
BE ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on July 17, 2006, the governing body conducted a public hearing on the
petition filed by Jack Fox, President of St. John's Military School, ("Petitioner") requesting
vacation of an eighty foot (80') utility easement located in the vacated right-of-way of Eight Street
from the north line of Otis Avenue to the south line of Euclid Avenue and an eighty foot (80')
utility easement located in the vacated right -of way of Teague Avenue from the east line of Ninth
Street to the west line of Eighth Street located in Blocks 64 and 81, Military Addition as depicted on
the attached and incorporated Exhibit "A".
that:
Section 2. That the governing body finds from the evidence presented at the public hearing
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by the vacation of the easements.
(c) Injustice to the Petitioner the vacation of the two utility easements should be granted.
Section 3. That the eighty foot (80') utility easement located in the vacated right-of-way of
Eight Street from the north line of Otis Avenue to the south line of Euclid Avenue and an eighty
foot (80') utility easement located in the vacated right -of way of Teague Avenue from the east line
of Ninth Street to the west line of Eighth Street located in Blocks 64 and 81, Military Addition in
the City of Salina, Saline County, Kansas are hereby vacated.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
