ORDINANCE NUMBER 06-10340
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE CONDITIONS
OF APPROVAL IN ORDINANCE NUMBER 04-10229, PROVIDING FOR THE REZONING
OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES
THEREOF.

WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW,

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "PC -3". PLANNED SHOPPING CENTER
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as
a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:
Lot 1 and a tract of land located in Lot 2, Block 2 of the Brock Addition to the
City of Salina, Saline County, Kansas, and more particularly described as
follows:
Beginning at the Northwesterly corner of Lot 2, Block 2 of said Brock
Addition;
Thence on an assumed bearing of N46048'45"E, a distance of 40.54
feet to a tangent curve to the right, said curve having a chord bearing
N64°35'1 6"E; a distance of 88.46 feet, a radius of 144.89 feet, and a
central angle of 35°33'01";
Thence on a bearing of S00008' 10"E, a distance of 127.72 feet;
Thence on a bearing of N88037'21"W, a distance of 9.40 feet;
Thence on a bearing ofN58°23'06"W, a distance of 117.86 feet to the
point of beginning. (aka 1930 S. Ohio Street)
shall become a part of District "PC -311. PLANNED SHOPPING CENTER.
Section 2. CONDITIONS OF APPROVAL. That the use of said described property
shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance
Number 8526, the same being Chapter 42 of the Salina Code with reference to the "C-2"
NEIGHBORHOOD COMMERCIAL DISTRICT regulations except as set out in this ordinance.
Development of the property shall be subject to the plans on file with the City Planning Commission
and/or City Clerk and the following conditions, to -wit:
1. Uses on Lot 1 and the above described portion of Lot 2 shall be limited to
a quick lube shop and uses permitted in the C-2 district.
2. Signage shall be limited to two (2) wall signs not exceeding seventy (70)
square feet in size, two logo signs and one (1) monument sign along Ohio
Street.
Section 3. That Ordinance Number 04-10229 is hereby repealed.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
