ORDINANCE NUMBER 95-9686
AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN
STREET RIGHT-OF-WAY ON PENN AVENUE, ADJACENT TO LOT ONE (1),
REPLAT OF BLOCK SIXTEEN (16) , OAKDALE ADDITION, TO THE CITY OF
SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That seventy (70) foot right-of-way of PENN AVENUE,
adjacent to said Lot One (1) , from the south line of Smoky Hill Drive, south to
the Old Smoky Hill river Channel in the City of Salina, Saline County, Kansas
is hereby vacated.
Section 2. That the above described portion of street right-of-way
on PENN AVENUE, which is vacated by this ordinance, shall be retained as a
utility easement.
Section 3. That the above described portion of street right-of-way
on PENN AVENUE, which is vacated by this ordinance, shall revert to the
ownership of Lot One (1) , Replat of Block Sixteen (16) , Oakdale Addition, in
accordance with K.S.A. 13-443.
Section 4. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
