ORDINANCE NUMBER 95-9671
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "R". SINGLE-FAMILY
RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas,
duly adopted and published as a part of Ordinance Number 8526, the same
being Chapter 42 of the Salina Code, be and it is hereby amended so that the
following described property be rezoned as follows, to -wit:
A tract of land located in the Northwest Quarter of the
Northeast Quarter and the Northeast Quarter of the
Northwest Quarter of Section 19, Township 14 South, Range
2 West of the 6th Principal Meridian in Saline County,
Kansas and described as follows:
Commencing at the Northwest corner of the Northeast
Quarter of said Section 19, thence S89"32' 19"W on the North
line of said Section 19 a distance of 487.62 feet;
thence S00'27'4111W a distance of 44.68 feet to the point of
intersection of the South Right -of -Way line of Crawford
Street with the West Right -of -Way line of Holly Lane, said
point also being the Northwest corner of Victoria Heights
Subdivision to Salina, Saline County, Kansas and being the
POINT OF BEGINNING of the tract to be described;
thence S00'25'53"W on said West Right -of -Way line a distance
of 791.83 feet;
thence, continuing on said West Right -of -Way line,
S25*16'38"E a distance of 267.78 feet;
thence, continuing on said West Right -of -Way line on a
curve to the left having a radius of 50.00 feet, a long
chord bearing of S08°20'33"E and a long chord distance of
59.03 feet, an arc distance of 63.15 feet;
thence S08'12'55"E a distance of 112.73 feet to a point on
the easterly line of the Flood Control Boundary for the
Smoky Hill River as described in Miscellaneous Book 67,
Page 314 and Miscellaneous Book 68, Page 116 in the Office
of the Register of Deeds, Saline County, Kansas;
thence N62*26'35"W on said boundary line a distance of
350.20 feet;
thence, continuing on said boundary line, N56016109"W a
distance of 392.01 feet;
thence, continuing on said boundary line, N32°27'33"W a
distance of 445.45 feet;
thence, continuing on said boundary line N30'22'56"E a
distance of 500.78 feet to a point on the South Right -of -Way
line of Crawford Street;
thence, S00'27' 13"W on said South Right -of -Way line a
distance of 5.00 feet;
thence, continuing on said South Right -of -Way line,
N79°11'09"E a distance of 51.14 feet;
thence, continuing on said South Right -of -Way line,
S89°32' 19"E a distance of 350.00 feet;
thence, continuing on said South Right -of -Way line,
N73°57'44"E a distance of 53.94 feet;
thence, continuing on said South Right -of -Way line,
S89°32' 19"E a distance of 37.21 feet to the point of
beginning. Contains 14.01 acres, more or less. SUBJECT
TO Easements, Reservations and Restrictions of record.

shall become a part of District "R". SINGLE-FAMILY RESIDENTIAL.
Section 2. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code with reference to the SINGLE-FAMILY
RESIDENTIAL. Development of the property shall be subject to the plans on
file with the City Planning Commission and/or City Clerk.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
