ORDINANCE NUMBER 06-10329
AN ORDINANCE PROVIDING FOR THE VACATION OF A SEGMENT OF
PLATTED RESTRICTED ACCESS ALONG THE EAST SIDE OF LOT ONE (1), BLOCK D IN
THE PARK WEST ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on May 15, 2006, the governing body conducted a public hearing on the
petition filed by Jimmy Q. Howell, Managing Member of RMQ, LLC ("Petitioner") requesting vacation
of Ten (10) feet of platted restricted access on the Broadway Boulevard frontage of Lot One (1), Block
D in the Park West Addition to the City of Salina, Saline County, Kansas to allow an existing platted
access opening to be widened from Twenty (20) feet to Thirty (30) feet.
Section 2. That the governing body finds from the evidence presented at the public hearing
that due and legal notice has been given by publication as required by law, that no private rights will be
injured or endangered by vacation of the restricted access that the public will suffer no loss or
inconvenience thereby, and that injustice to the Petitioner vacation of the restricted access should be
granted provided however:
a) The property owner shall dedicate restricted access along the south Fifteen
(15) feet of the east side of Lot One (1), Block D, Park West Addition in
order to maintain a Thirty (30) foot access opening.
Section 3. That for the purpose of recording this ordinance with the office of the Saline
County Register of Deeds, this vacation of restricted access that relates to that tract of real property
described as Lot One (1), Block D, Park West Addition to the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
