ORDINANCE NUMBER 94-9630
AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN
STREET RIGHT-OF-WAY ON CLAFLIN AVENUE, ADJACENT TO A PORTION OF
BLOCK ONE (1) , GILE ADDITION; BLOCK ONE (1) , LUNDBERG ADDITION;
AND BLOCKS ONE (1) AND FOUR (4), AUSTIN SUBDIVISION, ALL IN THE
CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That a portion of street right-of-way of Claflin
Avenue, adjacent to a portion of Block One (1) , Gile Addition; Block (1) ,
Lundberg Addition; and Blocks One (1) and Four (4) , Austin Subdivision, all
in the City of Salina, Saline County, Kansas, and more particularly described
as follows:
The right-of-way of Claflin Avenue beginning at
a point 150' east of the east right-of-way line
of Ohio Street and extending easterly to the west
right-of-way line of Austin Circle and being 60'
in width and containing 1.5 acres, more or less.
is hereby vacated.
Section 2. That the following described easements shall be
retained from the above described portion of street right-of-way on Claflin
Avenue which is vacated by this ordinance:
1. A 20' utility easement adjacent to the south side of the east
118.5' of Lot One (1) , all of Lot Two (2) , and the west 10' of
Lot Three (3) , all in Block One (1) , Gile Addition.
2. A 10' utility easement adjacent to the north side of the east
590' of Lot One (1) and all of Lot Two (2) in Block One (1) of
Lundberg Addition; and Lot Eight (8) in Block One (1) of
Austin Subdivision.
3. A 30' drainage and utility easement in Gile and Lundberg
Additions, adjacent to the east lines thereof.
4. A 20' drainage and utility easement in Austin Subdivision,
adjacent to the west line thereof.
Section 3. That the above described portion of street right-of-way
on Claflin Avenue which is vacated by this ordinance, shall revert to the
adjacent property owners as follows:
1. The north 37.13' of that portion adjacent to Lots One (1) , Two
(2) and Three (3), Block One (1), Gile Addition.
2. The south 22.87' of that portion adjacent to Lots One (1) and
Two (2) , Block One (1) , Lundberg Addition.
3. The north 30' of that portion adjacent to Lot Eighteen (18) ,
Block Four (4), Austin Subdivision.
4. The south 30' of that portion adjacent to Lot Eight (8) , Block
One (1) , Austin Subdivision.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
