Kansas (Published in The Salina Journal February 17 , 1994) ORDINANCE NUMBER 94-9622 AN ORDINANCE AMENDING SECTION 14-1 OF THE SALINA CODE REGARDING CONTRACTS FOR FIRE PROTECTION OF PROPERTY OUTSIDE THE CITY LIMITS, ADDING SECTIONS 14-2 THROUGH 14-5 REGARDING THE SAME, REPEALING THE EXISTING SECTION 14-1 OF THE SALINA CODE AND REPEALING RESOLUTION NUMBER 83-3685. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Section 14-1 of the Salina Code is hereby amended to read as follows: "Section 14-1. Contracts for fire protection for property outside the city limits. Pursuant to K.S.A. 80-1502, the city may enter into a fire protection contract with any county, township or individual or group of individuals, firm or corporation whose property is situated outside the city limits, to furnish firefighting service. A fire protection contract shall be made by ordinance and shall be assignable only upon prior written approval of the city manager. Section 2. That Chapter 14 of the Salina Code is hereby amended by adding the following sections: "Section 14-2. Calculation of charges. The annual charge for fire protection furnished by the city under a fire protection agreement shall be payable in advance and shall equal one hundred twenty-five percent (125%) of the mill levy required to provide fire protection service within the limits of the city for the year in which the contract is executed or renewed, multiplied by the most recently available assessed valuation of the property (including land, improvements and personal property) for which fire protection is to be furnished; subject, however, to a maximum annual charge for any one tract of property in one ownership of twenty-five thousand dollars ($25,000). "Section 14-3. Initial term. Regardless of the commencement date of any fire protection contract, the initial term of the contract shall end the next following December 31st. The charge for the initial term of the contract shall be calculated according to Section 14-2 above and shall be prorated on the basis of the number of months included in the initial term. "Section 14-4. Renewal. A fire protection contract shall renew on a calendar year-to-year basis if the annual charge prescribed in Section 14-2 above, as it now provides or as it may be amended, is paid to and accepted by the City no later than the December 31st immediately prior to the renewal term. "Section 14-5. Termination. A fire protection contract shall be subject to termination at any time that, upon the recommendation of the fire chief, the governing body finds it contrary to the public interest for the city to continue to provide fire protection service under the contract. Annexation of the real estate covered by a fire protection contract shall terminate the contract. Upon termination of a fire protection contract, the City shall pay to the property Kinn -C- Priming —Salina. Kansas owner a prorated refund based upon the number of months remaining in the term of the contract. Section 3. That the existing Section 14-1 of the Salina Code and Resolution Number 83-3685 are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
