ORDINANCE NUMBER 94-9620
AN ORDINANCE AMENDING ARTICLE VIII, DIVISION 1, OF CHAPTER
8 OF THE SALINA CODE REGULATING HEATING, VENTILATING, COOLING,
REFRIGERATION SYSTEMS AND INCINERATORS, AND REPEALING THE EXISTING
ARTICLE Vill, DIVISION 1.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That Article VIII, Division 1 of Chapter 8
of the Salina Code is hereby amended to read as follows:
"ARTICLE Vill. MECHANICAL CODE
DIVISION 1. GENERALLY
"Section 8-281. Uniform Mechanical Code adopted.
There is hereby adopted, by reference, by the
city for the purpose of providing minimum standards to
safeguard life or limb, health, property and public
welfare by regulating and controlling the design,
construction, installation, quality of materials,
location, operation, alteration, repair and
maintenance of heating, ventilating, cooling,
refrigeration systems, incinerators and other
miscellaneous heat -producing appliances, that certain
mechanical code known as the Uniform Mechanical Code,
recommended and published by the Internal Conference
of Building Officials, being particularly the 1991
edition thereof, and the whole thereof, except as
modified with this article, of which not fewer than
three ( 3 ) copies have been and now are f i I ed in the
office of the city clerk and the same is hereby
incorporated as fully as if set out at length herein,
and the provisions thereof shall be controlling in the
installation of all heat -producing appliances within
the corporate limits of the city.
"Section 8-282. Permit fees.
The fee for each perm i t or i nspect 1 on requ i red by
the Uniform Mechanical Code, 1991 edition, shall be as
set forth in a fee schedule adopted pursuant to
section 2-2 of the Salina Code In lieu of the fees
specified in section 304(a) and (b) of the Uniform
Mechanical Code, 1991 edition.
"Section 8-283. Amendment of section 807(c) of
the Uniform Mechanical Code.
Section 807(c) of the Uniform Mechanical Code Is
hereby amended to read as follows:
Unvented Heaters. Decorative Gas Loos. and
Fireplaces Unvented heaters, decorative gas logs, and
fireplaces may be installed, used, maintained and
permitted to exist in all Group A, B, and M
occupancies and R3 family dwellings, except bathrooms
and bedrooms. An unvented decorative gas log is a
listed natural or liquified petroleum gas burning log
w 1 th an open f I ame cons i st i ng of a meta I frame or base
supporting simulated logs which is designed so that
its primary function lies in the aesthetic affect of
the logs and flame. An unvented fireplace is a listed
unvented gas log permanently installed in a
freestanding enclosure or zero clearance enclosure
designed and approved for installation in walls or
other building structures. Unvented heaters, gas
logs, and fireplaces:

(1) Shall be equipped with an approved oxygen -
depletion sensor,
(2) Shall be listed,
(3) Shall not be installed in any room which
does not have an alternative primary source
of heat (does not apply to heaters),
(4) Shall have free air volume of at least 50
cubic feet for each 1,000 BTU's of thermal
output,
(5) Shall be permanently installed,
(6) Shall not be equipped or connected to any
automatic ignition or shut-off device except
the oxygen -depletion sensor,
(7) Must be fueled by natural gas or by liquid
propane, and
(8) Must bear label of American Gas Association
or be UL listed."
Section 2. That the existing Article VIII, Division 1 of
Chapter 8 of the Salina Code is hereby repealed.
Section 3. That this ordinance shall take effect and be in
force from and after its adoption and publication once in the
official city newspaper.
