96-9727 Zone Eastbank Estates(Published in The Salina Journal SeptemberA, 1998) ORDINANCE NUMBER 96-9727 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PDD". PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: A tract of land in the East half of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West, Saline County, Kansas, described as follows: Beginning at the east quarter corner of said Section Nineteen (19), thence on an assumed bearing of South 00 degrees 02 Minutes 37 seconds West, a distance of Four Hundred Eighty and Seventy -Seven Hundredths Feet (480.77'): thence South 88 degrees 47 distance of Six Hundred Hundredths feet (652.44'); thence North 16 degrees 17 distance of Six Hundred Hundredths feet (644.32'); minutes 56 seconds West, a Fifty -Two and Forty -Four minutes 58 seconds West, a Forty -Four and Thirty -Two thence North 89 degrees 19 minutes 55 seconds East, to a point on said right of way line, a distance of Seven Hundred Ninety -Four and Two Hundredths feet (794.02'); thence South 02 degrees 27 minutes 11 seconds West, along the west line of said right of way line, a distance of Two Hundred Forty -Two and One Hundredth feet (242.01'), to the point of beginning. Said tract contains Four Hundred Thirty -Four Thousand Three Hundred Fifty -Three and Eighty Hundredths (434,353.80) Square Feet or Nine and Ninety -Seven Hundredths (9.97) acres, more or less. shall become a part of District "PDD". PLANNED DEVELOPMENT DISTRICT. The above described property is platted as Lots One (1) through Eleven (11), Block One (1) in the Replat of the East Bank Estates Addition to the City of Salina, Saline County, Kansas. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1) Development limitations shall be as follows: All lots shall be subject to the permitted uses, lot size and bulk regulations specified in the R Single -Family Residential 2) A note shall be added to the preliminary development plan as follows: "Maintenance of streets, the common area and other open space areas delineated on the development plan will be the responsibility of the East Bank Estates Homeowner's Association. 3) East Bank Drive shall have a minimum of 25 feet of paved driving surface. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
