ORDINANCE NUMBER 95-9714
AN ORDINANCE
PROVIDING FOR
THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME
BEING CHAPTER
42 OF THE SALINA CODE,
AND
THE ZONING DISTRICT
MAP THEREIN
AND THEREBY ADOPTED
AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE
CITY
AND PRESCRIBING THE
PROPER USES
THEREOF AND AMENDING
THE
COMPREHENSIVE PLAN.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT OF COMPREHENSIVE PLAN. That the
Comprehensive Land Use Plan Map shall be amended redesignating the tract of
land described herein from Low -Density Residential to High -Density Residential.
Section 2. AMENDMENT. DISTRICT "PDD R-2.5". MULTI -FAMILY
PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City
of Salina, Kansas, duly adopted and published as a part of Ordinance Number
8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:
Lots 1 - 4, Block 1, Chapel Ridge Subdivision to the City
of Salina, Saline County, Kansas.
shall become a part of District "PDD R-2.5". MULTI -FAMILY PLANNED
DEVELOPMENT DISTRICT.
Section 3. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT
DISTRICT. Development of the property shall be subject to the plans on file
with the City Planning Commission and/or City Clerk and the following
conditions, to -wit:
1. Development land use limitations shall be as follows:
a) Lot 1 shall be limited to multi -family residential
development containing no more than 144 dwelling
units.
b) Lots 2, 3 and 4 shall be limited to multi -family
residential development containing no more than
152, 40, and 46 dwelling units, respectively.
c) All lots shall be subject to the regulations of
the R-2.5 Multi -family Residential District.
d) Lots 1 and 2 shall be considered a combined
development site and a restrictive covenant shall
be recorded granting the residents of Lot 2 the
same right to use the common facilities located on
Lot 1 as residents of Lot 1.
2) A final replat shall be submitted and approved prior to
final approval of this amended preliminary Planned
Development District.
3) A final development plan shall be submitted and
approved for each lot prior to issuance of a building
permit. The final site development plan for Lot 1
(Phase I) shall be in substantial conformance with the
approved preliminary site development plan, landscape
plans, and elevation drawings. Plans for signage,
lighting and dumpster enclosures shall be shown on
the final site development plan. The final development
plans for Lots 2, 3 and 4 shall be compatible with the
approved plans for Lot 1.
4) The applicant/owner shall submit a traffic study for
review and approval by the City in conjunction with an
application for approval of a final development plan
for Lot 2. If a second entrance drive is deemed to
be needed, the property shall be replatted to provide
a second entrance and same shall be constructed
during development of Lot 2.
5) The Fire Chief shall approve design plans for the
temporary fire lane connecting the Central Mall ring
road to Lot 1 prior to issuance of a building permit.
6) The City Engineer shall approve final site grading
and storm water drainage plans and shall certify that
adequate water supply exists to meet required fire
flows prior to issuance of a building permit.
7) The applicant/owner shall be responsible for the
widening of Magnolia Road from the Central Mall
entrance drive to Chapel Ridge Place, the installation
of a sidewalk from Lot 1 north to Wayne Avenue and
south to Magnolia Road, as well as all other required
on-site and off-site public improvements.
8) The development shall be in accordance with the
approved preliminary site plan/landscape plan,
preliminary plat and elevation drawings, incorporated
herein by reference.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
