ORDINANCE NUMBER 97-9830
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "R", SINGLE-FAMILY
RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas,
duly adopted and published as a part of Ordinance Number 8526, the same
being Chapter 42 of the Salina Code, be and it is hereby amended so that the
following described property be rezoned as follows, to -wit:
A tract of land in the East Half of Section Nineteen (19) ,
Township Fourteen South (T14S), Range Two West (R2W)
of the Sixth Principal Meridian, being in the City of
Salina, Saline County, Kansas described as follows:
Commencing at the south quarter corner of said Section
Nineteen (19) , thence North along the west line of said
East Half a distance of Eight Hundred Fifty-two and
Seventy-nine Hundredths (852.79) feet on an assumed
bearing of North Zero degrees Zero minutes Zero seconds
East (N.00°00'00"E.) to the point of beginning;
- thence continuing along said west line on an assumed
bearing of North Zero degrees Zero minutes Zero seconds
East (N.00°00'00"E.) a distance of Two thousand
Forty-nine and Fifty-nine Hundredths (2,049.59) feet;
- thence South Forty-two degrees Forty-three minutes
Seven seconds East (S.42°43'07"E.) a distance of Six
Hundred Twenty-five (625.00) feet;
- thence South Ninety degrees Zero minutes Zero seconds
West (S.90°00'00"W.) a distance of Sixty-seven (67.00) feet;
- thence South Twenty-eight degrees Fifteen minutes
Three seconds East (S . 28° 15'03"E .) a distance of Four
Hundred Fifty (450.00) feet;
- thence South Thirteen degrees Seventeen minutes
Fifty-three seconds East (S.13°17153"E.) a distance of
Seven Hundred Twenty-four and Eighty-five hundredths
(724.85) feet;
thence South Seven degrees Thirty-seven minutes
Twenty-four seconds West (S.07°37'24"W.) a distance of
Four Hundred Seventy-four and Forty-three Hundredths
(474.43) feet;
- thence South Eighty-eight degrees Twenty-six minutes
Twenty-one seconds West (S.88°26'21"W.) a distance of Six
Hundred Seventy-four and Seven Hundredths (674.07) feet
to the point of beginning.
The above described tract of land contains 1,079,793
square feet or 24.79 acres more or less.
The above described tract of land is subject to any
easements or right of ways of record.
shall become a part of DISTRICT "R", SINGLE-FAMILY RESIDENTIAL.
Section 2. CONDITIONS OF APPROVAL. The use of said described
property shall be subject to all the conditions, restrictions and limitations
as made and provided for in Ordinance Number 8526, the same being Chapter
42 of the Salina Code with reference to the "R", SINGLE-FAMILY
RESIDENTIAL DISTRICT regulations.
Section 3. That all prior ordinances in conflict herewith as they
relate to the above described real estate are hereby repealed.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
