ORDINANCE NUMBER 97-9822
AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON THE
OPENING AND OPERATION OF CERTAIN ADULT-ORIENTED BUSINESSES FOR
A PERIOD OF NINETY (90) DAYS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. Pending Ordinance. That, for the next approximately
ninety (90) days, the governing body is scheduled to have under consideration
studies relating to the deleterious secondary effects of certain adult-oriented
businesses and a draft ordinance relating to the location and licensing of
specifically (a) adult motion picture theatres, (b) adult arcades, and (c)
adult media or merchandise outlets.
Section 2. Moratorium. That, pursuant to its home rule authority
and in accordance with the "pending legislation" doctrine, the governing body
hereby imposes a temporary moratorium upon the opening and operation of any
adult-oriented business, as defined in the draft adult-oriented business
ordinance dated July 28, 1997, at any location in the City, for the reason that
until such time as the governing body can reach well -reasoned and documented
conclusions regarding the potentially deleterious effects of adult-oriented
businesses and thereafter consider adoption of appropriate zoning and licensing
regulations relating to such businesses, the opening and operating of such a
business within the City prior to the effective date of any new zoning and
licensing regulations would potentially undermine the public purpose served by
those regulations.
Section 3. Term of Moratorium. That the temporary moratorium
imposed
by this ordinance
shall
commence
upon
publication of this ordinance
and shall
continue in effect
for a
period of
ninety
(90) days thereafter.
Section 4. Copy of Draft Ordinance. That no less than three (3)
copies of the draft adult-oriented business ordinance, and any revisions
thereto, shall be maintained in the office of the City Clerk and be available
for review by the public during regular business hours.
Section 5. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
