ORDINANCE NUMBER 97-9818
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN
TRACTS OF LAND, IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE
PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the following described tracts of land, to -wit:
Tract 1:
A tract of land located in the South Half (Si) of the
Southeast Quarter (SE -41) of Section Twenty -Six (26),
Township Fourteen South (T14S), Range Three West (R3W)
of the Sixth Principal Meridian in Saline County, Kansas,
more particularly described as follows:
Commencing at the Southwest corner of the Southeast
Quarter (SE -1) of said Section Twenty -Six (26) ;
- Thence North along the West line of said Southeast
Quarter (SE -41) on an assumed bearing of North Zero
degrees Nine minutes Fifteen seconds East (N00°09' 15"E) , a
distance of Ninety-six and Twenty -Five Hundredths
(96.25) feet to the Point of Beginning;
- Thence North Eighty -Nine degrees Thirty -Eight minutes
Zero seconds East (N89°38'00"E), a distance of
Twenty -Two and Forty Hundredths (22.40) feet;
- Thence North Sixty -Six degrees Twenty -Five minutes
Thirty -Six seconds East (N66°25'36"E), a distance of
Thirty -Eight and Seven Hundredths (38.07) feet;
- Thence North Eighty -One degrees Twenty -One minutes
Twenty -Four seconds East (N81'21'24"E), a distance of
Four Hundred Eighty -Nine and Sixty -Seven Hundredths
(489.67) feet;
- Thence North Nine degrees Forty -One minutes
Thirty -One seconds West (N09°41'31"W), a distance of Five
Hundred Sixty -Seven and Ninety -Three Hundredths
(567.93) feet;
- Thence North Twenty degrees Twenty -Seven minutes
Thirty seconds West (N20027'30"W), a distance of One
Hundred Ninety -Eight and Thirty Hundredths (198.30) feet;
- Thence North Thirty -Five degrees Forty -Nine minutes
Twenty -Three seconds West (N35°49123"W) , a distance of
Two Hundred Forty -Two and Thirty -Four Hundredths
(242.34) feet;
- Thence North Fifty -Two degrees Fifty -Five minutes
Fifty -Nine seconds East (N52°55'59"E) , a distance of
Twenty -Five (25) feet to a point on the westerly
right-of-way of I-135 Highway;
- Thence northwesterly along said right-of-way on a
nontangent curve to the left having a radius of Five
Thousand Five Hundred Seventy -Nine and Fifty -Eight
Hundredths (5,579.58) feet, an arc distance of Two
Hundred Twenty -Three and Seventy -Eight Hundredths
(223.78) feet, said curve having a long chord of Two
Hundred Twenty -Three and Seventy -Seven Hundredths
(223.77) feet and a bearing of North Thirty -Eight degrees
Twelve minutes Thirty -One seconds West (N38'12'31"W);
- Thence South Eighty -Nine degrees Fifty -Seven minutes
Fifteen seconds West (S89 -57115"W), a distance of One
Hundred Twelve and Eighty -Nine Hundredths (112.89) feet
to a point on the West line of the Southeast Quarter (SE -41)
of Section Twenty -Six (26) ;
- Thence South Zero degrees Nine minutes Fifteen seconds
West (S00°09'15"W) along said West line, a distance of One
Thousand Two Hundred Twenty -One and Eighty -Eight
Hundredths (1,221.88) feet back to the Point of Beginning.
The above described tract of land contains Four Hundred
Sixty -Nine Thousand Eight Hundred Twenty -Six (469,826)
square feet or Ten and Seventy -Nine Hundredths (10.79)
acres, more or less.
Tract 2:
A tract of land located in the Northeast Quarter (NE -41) of
Section Thirty -Five (35) , Township Fourteen South
(TAS), Range Three West (R3W) of the Sixth Principal
Meridian in Saline County, Kansas, more particularly
described as follows:
Commencing at the Northwest corner of the Northeast
Quarter (NEI) of said Section Thirty -Five (35);
- Thence South along the West line of said Northeast
Quarter (NE -41) on an assumed bearing of South Zero
degrees Five minutes Four seconds East (S00°05104"E), a
distance of Fifty -Three and Seventy -Six Hundredths
(53.76) feet to the Point of Beginning;
- Thence North Eighty -Nine degrees Thirty -Eight minutes
and Zero seconds East (N89'38'00"E), a distance of
Fifty -Eight and Fifty -Five Hundredths (58.55) feet;
- Thence South Eighty -One degrees Twenty -Five minutes
Eighteen seconds East (581'25'18"E), a distance of Six
Hundred Four and Eighty -Six Hundredths (604.86) feet;
- Thence South Twenty -Six degrees Six minutes
Fifty -Eight seconds East (526.06'58"E), a distance of
Three Hundred Ten and Thirty -Nine Hundredths (310.39)
feet;
- Thence South Forty -One degrees Twenty -Nine minutes
Twenty -Six seconds East (S41°29'26"E), a distance of Four
Hundred Ninety and Forty -Eight Hundredths (490.48) feet;
- Thence South Thirty -One degrees Three minutes Five
seconds East (S31°03'05"E), a distance of Two Hundred
Fifty -Three and Sixteen Hundredths (253.16) feet to a
point on the westerly right-of-way of I-135 Highway;
- Thence South along said westerly right-of-way on a
nontangent curve to the right having a radius of Five
Thousand Five Hundred Seventy -Nine and Fifty -Eight
Hundredths (5,579.58) feet, an arc distance of Four
Hundred Six and Eighty -Six Hundredths (406.86) feet,
said curve having a long chord of Four Hundred Six and
Seventy -Seven Hundredths (406.77) feet and a bearing of
South Ten degrees Twenty -Nine minutes Three seconds
East (S 10°29'03"E) ;
- Thence South Eighty -Nine degrees Fifty -Three minutes
Fifteen seconds West (S89°53'15"W), a distance of One
Thousand Three Hundred Twenty and Fifty -Two
Hundredths (1,320.52) feet to a point on the West line of
the Northeast Quarter (NE -4L) of said Section Thirty -Five 35;
- Thence North Zero degrees Five minutes Four seconds
West (N00°05'04"W) along said West line, a distance of One
Thousand Three Hundred Fifty -Five and Forty -One
Hundredths (1,355.41) feet back to the Point of Beginning.
The above described tract of land contains One Million
Three Hundred Fifty -Seven Thousand Seven Hundred
Ninety -Two (1,357,792) square feet or Thirty -One and
Seventeen Hundredths (31.17) acres, more or less.
Tract 3:
A tract of land located in the Northeast Quarter of the
Northwest Quarter (NEQNW4) of Section One (1), Township
Fifteen South (T15S), Range Three West (R3W) of the
Sixth Principal Meridian in Saline County, Kansas, more
particularly described as follows:
Commencing at the Northwest corner of said Section One
(1);
- Thence North Eighty -Nine degrees Forty -Four minutes
Twenty -Nine seconds East (N89°44'29"E) along the North
line of said Section One (1), on an assumed bearing, a
distance of One Thousand Eight Hundred Thirty -Two and
'WM
Sixty -Seven Hundredths (1,832.67) feet, more or less, to
the Point of Beginning;
- Thence continuing along the North line of said Section
One (1) bearing North Eighty -Nine degrees Forty -Four
minutes Twenty -Nine seconds East (N89°44'29"E), a
distance of Three Hundred Twenty -Nine and Eighty -Eight
Hundredths (329.88) feet, more or less;
- Thence South Zero degrees Twenty minutes Thirty -Seven
seconds East (500'20'37"E), a distance of Four Hundred
(400.00) feet, more or less;
- Thence South Eighty -Nine degrees Forty -Four minutes
Twenty -Nine seconds West (S89°44'29"W) on a line parallel
with the North line of said Section One (1) , a distance of
Three Hundred Twenty -Nine and Eighty -Eight Hundredths
(329.88) feet, more or less;
- Thence North Zero degrees Twenty minutes Thirty -Seven
seconds West (N00'20'37"W) a distance of Four Hundred
(400.00) feet, more or less, to the Point of Beginning.
The above described tract contains Two and Five Hundred
Seventy Five Thousandths (2.575) acres, more or less,
excluding Four Hundred Fifty -Four Thousandths (0.454)
acres of right-of-way along Schilling Road.
meeting one or more of the classifications for annexation prescribed by K.S.A.
12-519 to 12-526, inclusive, is hereby annexed and made a part of the city of
Salina, Kansas.
Section 2. That the tracts of land described in Section 1 above
shall be zoned A-1, Agricultural District.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city
newspaper.
