97-9814 Establish Multi-yr FundORDINANCE NUMBER 97-9814 AN ORDINANCE ESTABLISHING A LIMITED PURPOSE MULTI-YEAR CAPITAL IMPROVEMENTS FUND. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Fund Established. In accordance with K.S.A. 12-1,118, there is hereby established a multi-year capital improvements fund to be entitled "Flood and Drainage Improvement Fund". Section 2. Purpose limited. The Flood and Drainage Improvement Fund shall be used only for the construction, repair, rehabilitation, alteration, installation, acquisition, or fabrication of flood and storm drainage capital improvements as enumerated in the City of Salina Capital Improvements Program and as authorized by K.S.A. 12-1,118. This may include: A. Materials and supplies necessary to effect the purposes of the fund. B. Fixed or portable equipment, provided that such equipment is dedicated solely to the prevention or mitigation of flood or inadequate storm drainage conditions. C. Professional services contracts directly related to the primary purpose of the fund, including preliminary engineering, design and feasibility studies. D. Other contractual services related to the primary purpose of the fund. E. Acquisition of real estate, improvements to real estate, and related personal property necessary to accomplish the purpose of the fund. F. Payment of principal, interest and related costs of debt issued for flood and Storm drainage improvements, either directly or through transfers to the Bond and Interest Fund. Work performed pursuant to the purposes of the Fund may be performed by the City, or contracted to others. However, fund resources shall not be used for payment of salary or benefits paid directly by the City of Salina to its employees, nor shall they be used to pay normal operating expenses of the City. Section 3. Annual Budget Required. Resources of the fund shall be subject to the annual budget process in the same manner as other City funds. Section 4. Ad Valorem Property Tax authorized. Pursuant to K.S.A. 12-1,118(a) and Section 5 of Article 12 of the Kansas Constitution, the City may annually levy up to 1 mill in Ad Valorem property taxes for the Flood and drainage Improvement fund, said taxes to be levied at the same time and manner as property taxes authorized for other City Funds. Section 5.
