ORDINANCE NUMBER 97-9813
AN ORDINANCE REVOKING AN AD VALOREM TAX EXEMPTION
GRANTED FOR CERTAIN PROPERTY OWNED BY REMA BAKEWARE, LOCATED
AT 625 EAST NORTH STREET, SALINA, KANSAS, AND REPEALING
ORDINANCE NUMBER 95-9673.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the ad valorem property tax exemption for
certain property owned by REMA Bakeware, located at 625 East North Street,
Salina, Kansas, granted by Ordinance Number 95-9673 (the "Ordinance") is
hereby revoked effective July 1, 1997, for the reasons that:
a. Under Section 10 of the Ordinance, the governing body
reserved the right to revoke the tax exemption for the applicant's
failure to comply with the terms and conditions of the Ordinance or
the provisions of the City of Salina Tax Exemption Policy (the
"Policy" as set forth in Resolution Number 91-4265) .
b. Section 5D of the Policy provided that: "No tax exemption
granted shall be continued if the business ceases operations or
ceases to be engaged in eligible business activities."
C. The manufacturing business which was the basis for
qualification for the tax exemption ceased operation on or about June
30, 1997.
Section 2. That Ordinance Number 95-9673 is hereby repealed.
Section 3. That the City Clerk is directed to file a certified copy
of this ordinance in the offices of the Saline County Appraiser and the Kansas
Board of Tax Appeals.
Section 4. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
