97-9800 Zone GICO AddC.W_WN (Published in The Salina Journal May /9, 1997) ORDINANCE NUMBER 97-9800 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT PDD R-2, PLANNED DEVELOPMENT DISTRICT - MULTIPLE FAMILY RESIDENTIAL. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots 1 - 12, Block 1 in the Replat of Lots 1 - 13, Block 5 in the GICO Addition being in the City of Salina, Saline County, Kansas. shall become a part of DISTRICT PDD R-2, PLANNED DEVELOPMENT DISTRICT - MULTIPLE FAMILY RESIDENTIAL. Section 2. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "R-2", MULTIPLE FAMILY RESIDENTIAL DISTRICT regulations, except that the minimum front yard setback shall be Twenty (20) feet on Lot 6 and that the lot widths/frontages shall be less than Twenty-four (24) feet on Lots 5, 6, 7, and 8 if those lots are split. In addition thereto this rezoning shall be subject to the following conditions, to wit: 1. Development of the site shall be limited to Twelve (12) two unit townhomes and shall substantially conform to the approved site development plan. The elevation sketch submitted by the applicant shall be incorporated as part of the approved preliminary development plan. 2. Each individual dwelling unit shall contain a minimum of 1,000 square feet and a maximum of 1,200 square feet of heated floor space and an attached double car garage. 3. Landscaping shall consist of One (1) street tree for each individual dwelling unit selected from the City's approved tree list and planted by the builder and other plantings selected and planted by the owner. 4. A driveway layout plan shall be submitted for review and approval prior to issuance of a building permit for Lots 4, 5, 6, 7, and 8. 5. Approval is subject to the approved Preliminary Development Plan which is on file in the Zoning Administrator's Office and is incorporated herein by reference. Section 3. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
