ORDINANCE NUMBER 97-9795
AN ORDINANCE PROVIDING FOR THE VACATION OF A SEGMENT
OF THE RESTRICTED ACCESS ON SOUTH NINTH STREET IN THE CITY OF
SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That on February 24, 1997, the governing body
conducted a public hearing on the petition of DMH & Associates, L.L.C.
( "Petitioner")
requesting
vacation of a
segment of
the restricted access
along
the west side
of South
Ninth Street,
thirty feet
(30') in width, the
center
line of which shall be located two hundred seventy-five feet (275') south of
the center line of Magnolia Road (the "Restricted Access") .
Section 2. That the governing body finds from the evidence
presented at the public hearing that due and legal notice has been given by
publication as required by law, that no private rights will be injured or
endangered by vacation of the Restricted Access, that the public will suffer no
loss or inconvenience thereby, and that in justice to the Petitioner vacation
of the Restricted Access should be granted.
Section 3. That the Restricted Access is hereby vacated effective
upon certification by the City Engineer that the proposed Mid -State Plaza
Ninth Street entrance has been constructed in accordance with the plans and
specifications submitted by the Petitioner to the City in compliance with
Resolution Number 97-5103.
Section 4. That for the purpose of recording this ordinance with
the office of the Saline County Register of Deeds, this vacation of restricted
access relates to that tract of real property described in Exhibit A, attached.
Section 5. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
