ORDINANCE NUMBER 97-9786
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "PDD (R-2)" . PLANNED
DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina,
Kansas, duly adopted and published as a part of Ordinance Number 8526, the
same being Chapter 42 of the Salina Code, be and it is hereby amended so
that the following described property be rezoned as follows, to -wit:
Lots Fifteen (15) and Sixteen (16) plus a part of Lot
Twenty (20), Bonnie Ridge Planned Community, described
a follows: Commencing at a point on the East line of Linda
Lane Seventy-five (75) feet South of the Southwest corner
of Lot One (1) , thence continuing South along said line
Forty-five (45) feet to the Northwest corner of Lot Fifteen
(15) , thence East One Hundred Thirty-five (135) feet,
thence North Forty-five (45) feet, thence West One
Hundred Thirty-five (135) feet to the point of beginning,
being in the City of Salina, Saline County, Kansas.
shall become a part of District "PDD (R-2)". PLANNED DEVELOPMENT
DISTRICT.
Section 2. CONDITIONS OF APPROVAL. The use of said described
property shall be subject to all the conditions, restrictions and limitations
as made and provided for in Ordinance Number 8526, the same being Chapter
42 of the Salina Code with reference to the PLANNED DEVELOPMENT
DISTRICT and the R-2 MULTI -FAMILY RESIDENTIAL DISTRICT regulations
except that the minimum front yard setback shall be Twenty (20) feet and the
minimum rear yard setback shall be Fifteen (15) feet and the right-of-way for
Arrowhead Lane shall be Thirty-five (35) feet instead of the required
Forty-five (45) feet. In addition thereto this rezoning shall be subject to
the following conditions, to wit:
1. Development of the site shall be limited to five (5) two unit
townhomes and shall substantially conform to the approved site
development plan. The elevation sketch submitted by the
applicant shall be incorporated as part of the approved
preliminary development plan.
2. An application for approval of a final development plan for this
site shall be filed within two (2) years. Said final
development plan shall include a detailed landscape plan and
architectural elevation drawings consistent with the elevation
sketch of the townhome units.
3. Plans and specifications for on-site drainage improvements
(swale, inlets, pipes and outlets) and a site grading plan shall
be approved by the City Engineer prior to issuance of any
building permit. Construction of improvements shall be
complete prior to issuance of any certificates of occupancy.
4. Approval is subject to the approved Preliminary Development
Plan which is on file in the Zoning Administrator's Office and
is incorporated herein by reference.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
