96-9770 Zone Riffel Add(Published in The Salina Journal February oo , 1997) ORDINANCE NUMBER 96-9770 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -7". PLANNED HIGHWAY COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: A tract of land in the North one half of the Northeast Quarter (NINE -1) of Section Two (2), Township Fifteen South (T15S), Range Three West (R3W) of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas described as follows: Commencing at the Northeast Corner of said Northeast Quarter (NE4) , thence westerly along the north line of said Northeast Quarter (NE -41) on an assumed bearing of North 89 degrees 37 minutes 00 seconds West (N.89 -37'00"W.) a distance of 600.94 feet; thence South 00 degrees 27 minutes 30 seconds West (S.00°27'30"W.) a distance of 44.00 feet to the point of beginning: - thence South 89 degrees 37 minutes 00 seconds East (S.89 -37'00"E.), a distance of 192.80 feet; - thence South 00 degrees 23 minutes 00 seconds West (S.00023100"W.), a distance of 61.00 feet; - thence South 89 degrees 37 minutes 00 seconds East (S.89037'00"E.), a distance of 182.00 feet; - thence South 46 degrees 49 minutes 10 seconds East (S.46 -49'10"E.), a distance of 53.10 feet, to the west right of way line of Old U. S. 81 Highway; - thence South 00 degrees 00 minutes 40 seconds West (S.00 -00'40"W.), along said Highway 81 right of way a distance of 354.65 feet; - thence South 15 degrees 01 minutes 10 seconds East (S. 15001'10"E.), along said Highway 81 right of way a distance of 25.19 feet; - thence South 13 degrees 18 minutes 11 seconds East (S. 13-18'11"E.), along said Highway 81 right of way a distance of 91.39 feet; - thence South 00 degrees 08 minutes 39 seconds West (S.00 -08'39"W.), along said Highway 81 right of way a distance of 476.55 feet; - thence South 16 degrees 49 minutes 29 seconds West (S .16°49'29"W.) , along said Highway 81 right of way a distance of 248.64 feet; - thence North 89 degrees 54 minutes 34 seconds West (N.89054'34"W.), a distance of 704.65 feet to the east right of way line of Interstate 135 Highway; - thence North 00 degrees 24 minutes 58 seconds East (N.00 -24'58"E.), along said 135 Interstate right of way a distance of 298.70 -feet; - thence North 07 degrees 46 minutes 16 seconds East (N.07 -46'16"E.), along said 135 Interstate right of way a distance of 273.53 feet; - thence North 15 degrees 04 minutes 23 seconds East (N .15°04'23"E .) , along said 135 Interstate right of way a distance of 258.23 feet; - thence North 19 degrees (N. 19-29'42"E.), along said distance of 466.77 feet; - thence North 80 degrees (N.80 -12'42"E.), a distance beginning. 29 minutes 42 seconds East 135 Interstate right of way a 12 minutes 42 seconds East of 77.14 feet to the point of The above described tract of land includes the existing Riffel Estates Subdivision. The above described tract of land contains 838,029.65 square feet or 19.24 acres more or less. The above described tract to be platted and known as the RIFFEL ADDITION to the City of Salina, Saline County, Kansas. shall become a part of District "PC -7". PLANNED HIGHWAY COMMERCIAL DISTRICT. 1) Permitted uses shall be limited to those listed in the C-7 regulations and shall be subject to all bulk and use limitations in the C-7 district with the addition of warehousing as a conditional use. 2) Signage on the site shall comply with C-7 regulations. 3) The developer shall be responsible for the new frontage road shown on the plat drawing as well as the Ninth Street median crossing and associated intersection improvements at Ninth Street and Schilling Road. 4) A final site development plan for the entire development or for each individual building site shall be approved by the Planning Commission prior to issuance of any building permits. 5) A building permit for Phase I shall be applied for within 18 months of the approval date or the approved development plan shall become null and void and the zoning shall revert to its former classification. 6) Development of the site, including landscaping, shall conform to the approved site development plan and landscaping plan. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED HIGHWAY COMMERCIAL DISTRICT.
