ORDINANCE NUMBER 96-9764
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "PC -5". PLANNED SERVICE
COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina,
Kansas, duly adopted and published as a part of Ordinance Number 8526, the
same being Chapter 42 of the Salina Code, be and it is hereby amended so
that the following described property be rezoned as follows, to -wit:
Lots 84 and 86 on 9th Street, plus the north half of
vacated Russell Avenue in the Grounds of KWU Addition to
the City of Salina. More commonly known as 1617 - 1621
S. 9th St.
Shall become a part of District "PC -511. PLANNED SERVICE COMMERCIAL.
Section 2. CONDITIONS OF APPROVAL. The use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 42 of the Salina Code with reference to the PLANNED SERVICE
COMMERCIAL DISTRICT. Development of the property shall be subject to the
plans on file with the City Planning Commission and/or City Clerk and shall be
subject to the following conditions:
1. Permitted uses shall be limited to used car display and
sales plus other uses permitted in the C-3 district.
2. The property shall not be converted to the display and
sale of used cars until a separate driveway is
constructed for the existing dwelling and a screening
fence is erected between the rear yard area of the
dwelling and car display area.
3. Paving coverage shall be limited to 60% of the required
front yard.
4. Proposed trees shall comply with city guidelines for
type and size and be from the City's approved street
tree list.
5. Development shall be completed in substantial
conformance with the site plan and associated
submittals.
6. If the applicant fails to remove the existing house or
convert it to an office by November 1, 1997, the
Planned C-5 zoning shall be deemed to be revoked
and the subject property shall automatically revert
back to its former C-3 zoning classification and the
property shall cease to be used for the display and
sale of cars.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
