ORDINANCE NUMBER 97-9842
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF
UTILITY EASEMENT IN HIGHLAND MEADOWS HAMLET, AN ADDITION TO
E CITY OF SALINA, SALINE COUNTY, KANSAS.
li:BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas
Section 1. That on December 1, 1997, the governing body
conducted a public hearing on Petition Number 4154, filed by R. Steven Preston,
Martha J. Preston and H.M.H. of Salina, LLC ("Petitioners"), requesting vacatior
of part of the 20' utility easement located on Lots One (1) , Two (2) and Three
(3) , Block Four (4) , Highland Meadows Hamlet, an addition to the City of Salina,
Saline County, Kansas, more particularly described as follows:
The northwesterly Ten (10) feet of the Twenty (20) foot utility
easement located along the Southeasterly line of Lots One (1) , Two
(2) and Three (3) , Block Four (4) , Highland Meadows Hamlet, an
addition to the City of Salina, Saline County, Kansas;
The above described easement to be vacated contains 4,644 square
feet, more or less.
Section 2. That the governing body finds from the evidence
presented at the public hearing that:
(a) Due and legal notice has been given by publication as required
by law.
(b) No private rights will be injured or endangered by vacation of
the Right -of -Way.
(c) In justice to the Petitioner vacation of the easement should be
granted.
Section 3. That the northwesterly Ten (10) feet of the easement is
hereby vacated and shall revert to the owners of Lots 1, 2, and 3, Block 1,
Highland Meadows Hamlet, an addition to the City of Salina, Saline County,
Kansas. The southeasterly Ten (10) feet of the platted Twenty (20) foot
utility easement shall remain as platted.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
