ORDINANCE NUMBER 97-9841
AN ORDINANCE PROVIDING FOR THE VACATION OF THE PUBLIC
UTILITY EASEMENT IN THE SHONEY'S ADDITION TO THE CITY OF SALINA,
SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1.
That
on November
24,
1997, the governing body
conducted a public
hearing
on the petition
of
Dan Frederking ("Petitioner")
II requesting vacation of the public utility easement in the Shoney's Addition to
11the City of Salina, Saline County, Kansas, more particularly described as
II follows:
The West Ten (10) feet of Lot 3, except the North Ten (10) feet and
the South Ten (10) feet thereof, and the East Ten (10) feet of the
South One Hundred Five and Twenty-seven Hundredths (105.27) feet
of Lot 2, less the South Ten (10) feet thereof, Block 1 of the
Shoney's Addition to the City of Salina, Saline County, Kansas.
Section 2. That the governing body finds from the evidence
presented at the public hearing that:
(a) Due and legal notice has been given by publication as required
by law.
(b) No private rights will be injured or endangered by vacation of
the Right -of -Way.
(c) In justice to the Petitioner vacation of the Right -of -Way should
be granted.
Section 3. That the utility easement is hereby vacated and full
right of use shall
revert to the owners of Lot 3 and
the East Twenty (20)
feet
of the South One
Hundred Fifteen and Twenty-seven
Hundredths (115.27)
feet
of the West Five
Hundred Eighty-two and Thirty-six
Hundredths (582.36)
feet
of Lot 2, Block 1 of the Shoney's Addition to the City of Salina, Saline
County, Kansas.
Section 4. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
