ORDINANCE NUMBER 97-9840
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES
AND PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE
PURPOSE OF PAYING A PORTION OF THE COST OF
PROJECT NO. 96-971
CHAPEL RIDGE SUBDIVISION
Curbing, guttering, grading, paving and drainage of Chapel Ridge
Place from Magnolia Road to the Chapel Ridge Place cul-de-sac.
BELMONT PLAZA ADDITION
Curbing, guttering, paving, grading and drainage:
of Planet Avenue (frontage road) from the south line of Lot 3, Block
3, to the north line of Lot 1, Block 3; and
of Belmont Boulevard from the west right-of-way line of South Ninth
Street to the west right-of-way line of Planet Avenue; and
The installation of sanitary sewer main; and
The installation of water main; and
The installation of a stormwater detention basin and associated pump
station and pipelines.
TASKER ADDITION
Curbing, guttering, paving, grading and drainage of Berkley Lane
from the east line of Ray Avenue to the south line of Lot 23, Block
3, including Lisa Court; and
The installation of sanitary sewer main; and
The installation of water main.
VALLEY VIEW ADDITION
The installation of a water main.
NORD SUBDIVISION AND
WALLERIUS ADDITION
Curbing, guttering, paving, grading and drainage of:
Saturn Avenue from the west line of Hageman Avenue to the north
line of Meadowlark Lane; and
Mars Avenue from the north line of Meadowlark Lane to the south
line of Lot 15, Block 13, Wallerius Addition; and
Neptune Avenue from the north line of Meadowlark Lane to the north
line of Lot 10, Block 13, Wallerius Addition.
PROJECT NO. 95-924
MAGNOLIA INTERCHANGE IMPROVEMENTS
The construction of a new highway interchange including bridge,
roadway, on and off ramps, drainage structures, retaining walls,
traffic control devices, lighting and other related improvements.

SCHILLING ROAD IMPROVEMENTS
Curbing, guttering, grading, paving and storm drainage
improvements.
All in the City of Salina, Saline County, Kansas.

and such contracts have been duly performed, and
WHEREAS, the Board of Commissioners has determined that the total
cost of such improvements is Eight Million Three Hundred Eighteen Thousand
Three Hundred Twenty-two and 81/100 Dollars ($8,318,322.81) and that 19.0
percent in the amount of One Million Five Hundred Eighty Thousand Four
Hundred Ninety-nine and 56/100 Dollars ($1,580,499.56) be assessed against
the improvement district and that 81.0 percent in the amount of Six Million
Seven Hundred Thirty-seven Thousand Eight Hundred Twenty-three and
25/100 Dollars ($6,737.823.25) be assessed against the city -at -large.
WHEREAS, the Board of Commissioners has, after due notice, met
land determined the amount of special assessments, SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That special assessments to pay the cost of such
improvements, with accrued interest, be and the same are hereby levied
against the several lots, pieces and parcels of land liable for special
assessments for said improvements as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first
becoming due with the taxes levied for the year 1998 (except as otherwise
provided in the specific case of those lots referred to in Section 4 below) ,
and one of said installments falling due each and every year thereafter until
all are paid and all to be collected with interest as in this ordinance
provided; HOWEVER, that the owner of any piece or parcel of property liable
for any such assessments may redeem his property, in whole or in part, from
such liability by paying to the City Treasurer the entire amount, or a portion
thereof, chargeable against the same, as in this ordinance provided, at any
time within thirty days after the publication of this ordinance and before the
issuance of bonds of said City in payment of the balance of the cost of said
improvements, and to the extent of any such payment, the property so paid on
shall not thereafter be liable for any further assessments for the cost of said
improvements, nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate
per annum as shall be borne by bonds hereinafter to be issued for the
payment of the remaining unpaid cost of such improvements to be hereafter
determined and fixed by ordinance.

Section 4. In the case of Tract #20372, a part of Project No.
95-928, and Tract #14286 and Tract #14293, which are a part of Project No.
95-924, the first installment shall become due with the taxes levied no later
than 15 years after the original project assessments began (2013) or until such
property is platted or developed, whichever occurs first.
Interest on these tracts shall begin to accrue in accordance with
Section 3 above.
Section 5. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city newspaper.
