97-9838 Zone Holiday ResortC-0aleG-Sam (Published in The Salina Journal November,14 1997) ORDINANCE NUMBER 97-9838 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF SECTION 2 OF ORDINANCE NUMBER 98-9573 REGARDING THE CONDITIONS, RESTRICTIONS AND LIMITATION FOR HOLIDAY RESORTS ADDITION PDD AND REPEALING THE EXISTING SECTION. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Holiday Resorts Addition to the City of Salina, Saline County, Kansas is zoned as a Planned Development District with use conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the Planned Development District. Development of the property is subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions originally established by Section 2 of Ordinance Number 93-9573 and which are hereby amended to read as follows: Development limitations shall be as follows: a) Lot 8, Block 1 shall be limited to an adult care/nursing home facility containing no more than 120 beds. b) Lot 3, Block 4 shall be limited to an assisted living/group care facility for the elderly (age 60 and over) containing no more than 35 units. c) That part of Lot 3, Block 4 designated as a drainage easement shall be limited to a storm water retention pond having a minimum capacity of 90,000 gallons. d) All storage of materials and equipment on Lot 8, Block 1 and Lot 3, Block 4 shall be within a completely enclosed building. e) All other lots shall be limited to the uses permitted in the R Single -Family Residential District. f) All lots shall be subject to the lot size and bulk regulations specified in the R Single -Family Residential District. 2. The City Engineer shall approve plans and specifications for the storm water detention pond prior to issuance of any building permit; construction shall be completed prior to issuance of a certificate of occupancy. In the event surface runoff is insufficient to maintain the required minimum capacity, groundwater wells and/or public water sources shall be employed to maintain 90,000 gallons of water in the retention pond for fire protection purposes at all times. 3. The City Engineer shall certify that satisfactory contracts are in place for the construction of city water system improvements projected to be sufficient to meet minimum fire -flow requirements for any proposed buildings or the owner shall comply with applicable exemption criteria prior to issuance of a building permit. 4. The Fire Chief shall approve plans and specifications for the drafting station and emergency entrance from Holmes Road prior to the issuance of a building permit; construction shall be completed prior to issuance of a certificate of occupancy. 5. Development of Phases I & II - The Adult Care/Nursing Home Facility and the Assisted Living Complex shall substantially conform to the approved preliminary development plan and the exterior elevation drawings submitted by the applicant shall be incorporated as part of the preliminary planned development district. 6. A separate request for final development plan approval for Phases I & II - The Adult Care/Nursing Home facility and the Assisted Living Complex shall be filed following approval of the preliminary planned development district. Section 3. That Section 2 of Ordinance Number 93-9573 is hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
