AN ORDINANCE PROVIDING FOR THE VACATION OF PORTIONS OF
's PUBLIC RIGHT—OF—WAY OF COLUMBIA AVENUE AND SMOKY HILL DRIVE
THE OAKDALE ADDITION TO THE CITY OF SALINA, SALINE COUNTY,

BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. That on January 26, 1998, the governing body conducted
public hearing on the petition of Harold Martin ( "Petitioner") requesting
acation of the existing right-of-way for Columbia Avenue south of barricade
nd Smoky Hill Drive east of Columbia Avenue, adjacent to Lot Nine (9) , Block
leven (11) , Oakdale Addition to the City of Salina, Saline County, Kansas,
lore particularly described as follows:
Beginning at a point on the west line of Columbia Avenue extended
at the south side of a stone wall, said point being Forty-four and
Forty Hundredths (44.40) feet south of an iron bar marking the
southeast corner of Lot Thirteen (13) , Block Twelve (12) , Oakdale
Addition;
- Thence Northeasterly along the South side of said stone wall a
distance of Seventy-one and Ninety Hundredths (71.90) feet, more
or less, to the East line of Columbia Avenue extended;
- Thence North along said East line extended, a distance of
Forty-nine and Twenty Hundredths (49.20) feet to the southwest
corner of Lot Nine (9) , Block Eleven (11) , Oakdale Addition;
- Thence Northeasterly along the South line of said Lot Nine (9) ,
a distance of One Hundred Seventy and Twenty Hundredths (170.20)
feet to a point on the West side of a North-South alley, said point
being Ninety-seven (97) feet South of an iron pipe marking the
Northeast corner of Lot Eight (8) , Block Eleven (11) , Oakdale
Addition;
- Thence South along the West edge of said alley extended, a
distance of Twenty (20) feet to the high bank of the Old Smoky Hill
River Channel;
- Thence Southwesterly along said high bank, a distance of Two
Hundred Sixty-eight and Seventy Hundredths (268.70) feet, more or
less, to the West line of Columbia Avenue extended;
- Thence North along said West line a distance of Thirty-eight
(38) feet back to the Point of Beginning.
The above described right-of-way to be vacated contains Twenty-two
Hundredths (.22) acres, more or less.
Section 2. That the governing body finds from the evidence
presented at the public hearing that:
(a) Due and legal notice has been given by publication as required
by law.
(b) No private rights will be injured or endangered by vacation of
the Right -of -Way.
(c) In justice to the Petitioner vacation of the Right -of -Way should
be granted.
Section 3. That the Right -of -Way is hereby vacated and shall revert
to the owners of Lot 9, Block 11, Oakdale Addition to the City of Salina, Saline
County, Kansas.
Section 4. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
