98-9871 Zone Auburndale Add(Published in The Salina Journal Zu)y 10,1998) ORDINANCE NUMBER 98-9871 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -311, PLANNED SHOPPING CENTER DISTRICT and "PC -5" PLANNED SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots Two through Seven (2 - 7), Block One (1) of the Auburndale Addition to the City of Salina, Saline County, Kansas. shall become a part of DISTRICT "PC -311, PLANNED SHOPPING CENTER DISTRICT and Lot One (1), Block One (1) of the Auburndale Addition to the City of Salina, Saline County, Kansas shall become a part of DISTRICT"PC-5" PLANNED SERVICE COMMERCIAL DISTRICT. Section 2. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "PC -311, PLANNED SHOPPING CENTER DISTRICT and "PC -5" PLANNED SERVICE COMMERCIAL DISTRICT regulations and development of the property shall also be subject to the following conditions, to wit: 1. Development limitations shall be as follows: a. Development of Lot 1, Block 1 shall be limited to a lumber yard with outdoor storage plus those uses listed in the "C-3" district regulations and shall be subject to all bulk and use limitations in the "C-3" district, except that an outdoor garden center shall be permitted to cover an area equal to Sixty percent (60%) of the building floor area and the maximum building height shall be Forty (40) feet. b. Development of Lots 2-7, Block 1 shall be limited to those uses listed in the "C-3" district regulations and shall be subject to all bulk and use limitations in the "C-3" district, except that the maximum building height shall be Forty (40) feet. C. Signage on Lot 1 shall be limited to one (1) freestanding pylon sign per street frontage with a maximum permitted sign area of One Hundred Sixty (160) square feet and a maximum sign height of Thirty (30) feet. Signage on Lots 2-7 (the outlots) shall be limited to One (1) pole sign with a maximum permitted sign area of One Hundred Thirty (130) square feet and a maximum sign height of Thirty (30) feet. Facade or wall signs for individual businesses shall be subject to the "C-3" sign regulations. d. Parking for retail uses shall be limited to Five (5) spaces per One Thousand (1,000) square feet of floor area unless an exception for additional parking is approved by the City Commission. 2. A final plat shall be submitted and approved prior to final approval of the planned commercial district. 3. The City Engineer shall approve plans and specifications for the storm water detention ponds prior to issuance of any building permit; construction shall be completed prior to issuance of a certificate of occupancy for any lot in the subdivision. 4. The developer shall be responsible for the installation of all off-site improvements on Ninth Street and Schilling Road shown on the site plan drawing. No development shall occur on the north half of the site until the fourth lane on Schilling Road is constructed. No development shall occur on the south half of the site until the Ninth Street median crossover, left turn lane and entrance are constructed. 5. The developer shall be responsible for the installation of a traffic signal at Ninth Street and Riffel Drive should a warrant for a traffic signal at that intersection be met within the next Ten (10) years. This requirement shall be met by an escrow agreement, letter of credit, restrictive covenant or some other suitable financial guarantee prior to final approval of the planned commercial district. 6. A final site development plan and final landscape plan for the entire development of for each individual building site, including the detention pond sites, containing all required revisions and amendments shall be approved by the Planning Commission prior to issuance of any building permits. 7. A building permit for Phase I shall be applied for within Eighteen (18) months of the approval date or the approved development plan shall become null and void and the zoning shall revert to its former classification. 8. Development of the site, including landscaping, shall conform to the approved final site development plan. Section 3. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
