98-9870 Zone Schilling Subdiv 7(Published in The Salina Journal Alo✓e.w, e,, 31998) AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PDD", PLANNED DEVELOPMENT DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: The South Nine Hundred Fifty (950) Feet of Lot 3, Block 1, of the Schilling Subdivision No. 7, City of Salina, Saline County, Kansas shall become a part of DISTRICT "PDD", PLANNED DEVELOPMENT DISTRICT. Section 2. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to "PDD", PLANNED DEVELOPMENT DISTRICT. Regulations and development of the property shall also be subject to the following conditions, to wit: Development limitations shall be as follows: a. Permitted uses on the South 950 feet of Lot 3 shall be limited to a concrete batch plant plus any use permitted in the I-2 District. b. The concrete plant shall be equipped with cement dust containment equipment which meets KDHE standards. C. Truck traffic to and from the concrete plant shall enter and exit through the applicant's driveway entrance on Magnolia Road. Any additional use of the access easement to the west out to Centennial Road must be approved by the salina Airport Authority. If concrete trucks use this route, the roadway must be paved to public or private street standards. d. All drainage channel realignments shown on the plan shall be reviewed and approved by the City Engineer prior to any work taking place. The work shall be completed in accordance with approved plans. e. Development shall be completed in substantial conformance with the approved development plan on file with the Zoning Administrator and associated submittals in the case file. 2. A final development plan for the site shall be filed with the Zoning Administrator prior to issuance of a building permit for the concrete plant. Section 3. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 4.
