RESOLUTION NUMBER 06-6270
A RESOLUTION GRANTING AN EXTENSION OF TIME FOR THE REPAIR OR
REMOVAL OF CERTAIN STRUCTURES FOUND TO BE UNSAFE OR DANGEROUS, AND
AFFIXING A REASONABLE EXTENSION OF TIME WITHIN WHICH THE REPAIR OR
REMOVAL OF STRUCTURES SHALL BE COMPLETED.

w WHEREAS, on December 12, 2005, the City's Building Official filed with the Board of
City Commissioners a written statement that certain structures located within the City of Salina were
unsafe or dangerous, and
a
WHEREAS, the Building Official has advised the Board of City Commissioners that the
following structures located upon the described real estate continue to be unsafe or dangerous:

All in the City of Salina, Saline County, Kansas, and
WHEREAS, on December 12, 2005, the Governing Body of the City of Salina, Kansas,
adopted Resolution Number 05-6226, determining 4:00 p.m. on February 6, 2006, in Room 107 of
the City -County Building, 300 West Ash, Salina, Kansas, to be the time and place at which the
owner, the owner's agent, any lienholders of record, and any occupant of such structure could appear
and show cause why such structures should not be condemned and ordered repaired or removed, and
WHEREAS, on February 6, 2006 the Governing Body of the City of Salina, Kansas,
adopted Resolution No. 06-6245 directing the repair or removal of the buildings or structures
described above and require such work be commenced by February 6, 2006 and substantially
completed no later than March 27, 2006; and
WHEREAS, at the regular meeting of the Governing Bedy of the City of Salina, Kansas
on March 27, 2006 the owners of the respective properties appeared, reported on the status of their
respective projects, and requested additional time to complete the work; and
WHEREAS, upon considering the evidence presented regarding the structures located
upon the above described real estate, the Governing Body desires to make its findings and direct
certain action in relation to the structures, SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1. The owner of the house located at 238 S. Tenth Street shall no later than
August 28, 2006 fully complete the work outlined in the letter attached and incorporated as
Exhibit "A".
Section 2. The owner of the structure located at 252 Smithers shall no later than May
26, 2006 fully complete the work outlined in the General Compliance Order attached and
incorporated as Exhibit "B".
Section 3. If the owner fails to fully complete the required work within the stated period
of time, the Governing Body will cause the buildings or structures to be repaired or razed and
removed pursuant to K.S.A. 12-1755.
Section 4. That this resolution shall be in full force and effect from and after its adoption
by the Board of Commissioners and the City Clerk shall cause it to be published once in the official
city newspaper as required by K.S.A. 12-1753.
Adopted by the Board of Commissioners nd signed by the Mayor this 3`d day of April

Special Condition # 3 to the Permit
On February 6, 2006 the Salina City Commission passed Resolution #06-6245 which determined that
certain buildings or structures were found to be dangerous and that such conditions or defects exist to
the extent that the life, health, property or safety of the public is endangered. One of the structures
included in this resolution is the single family dwelling commonly known as 238 S. 10th Street, Salina,
KS. A copy of the resolution is also included in this letter. Section 2 of the resolution directs owner or
agent to repair or remove the buildings or structure and to make the premises safe and secure. Such
work shall be commenced by February 6, 2006 and shall be diligently prosecuted so as to allow for
substantial completion of the work no later than March 27, 2006.
Substantial completion for the repairs/renovation of 238 S. 10th Street shall include -

1. The fire damaged areas of the roof shall be repaired where possible and/or replaced.
2. The roof covering must be removed and replaced.
3. All exterior fire damage must be repaired (structural members, framing, sheathing, windows, and
weatherproof covering).
4. All interior fire damage must be repaired (structural members, framing, drywall, and electrical
work).
Inspection of these required repairs shall be requested and performed prior to March 27, 2006.

September 30, 2005. Call for a final inspection when completed.
Owner agrees the item(s) listed above must be completed by the agreed upon date. Once the required items
are completed please contact the Division of Building Services at 785-309-5715 to schedule a compliance
inspection. Further the owner understands and agrees that failure to complete the required items by the
agreed upon date may result in withdrawal of the right to occupy this property and/or prosecution in Salina
Municipal Court for violation of City Ordinances.
