5887 Utility Imp-Bailey HeightsD ORDINANCE NUMBER ,J887 __ C OVSOL:7� -.J :.:\LI:1 Published In the Salina Journal AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary- Sewer Districts Numbered 303, 304 and 305, and providing for the construction of a lateral sanitary sewer in each of said Lateral Sanitary Sewer Districts Numbered 303, 304 and 305, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas Section 1. Lateral Sanitary Sewer District Number 3022. That there be and there is hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer i District Number 303 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: i Benefit District. All of Blocks 1 and 2, Bailey Heights Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V.C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 303 as created by Section 1 of this ord- inance along the following course, to -wit: An 8 inch clay pipe sewer beginning at a manhole in Ohio Street and seven feet west of the center line thereof, and on the center line extended east of the j easement in Replat of Block 1, Claflin's Addition. to the Grounds of Kansas Wesleyan University; thence west along the center line of said easements in Blocks 1 and 2 of said Replat to a point 115 feet east of the east line of Roach Street where a manhole will be constructed which will be the terminus of Lateral 303, Section 3. Lateral Sanitary Sewer District Number 30z;-. That there be and i there is hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer I District Number 304 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. All of Ostenberg's Replat of Part of Blocks l,a.nd 2, Hagernan Park, City of Salina, Saline County, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 304 as created by Section 3 of this ordi- nance along the following course, to -wit: An 8 inch clay pipe sewer beginning at a manhole 20 feet north of the south line of McAdams Road and on the center line of Pearl Avenue; thence south along the center line of Pearl Avenue 140.6 feet; thence west along easement on the north line of Lot 12 of the Ostenberg's Replat of Part of Blocks land 2, Hageman Park to the northwest corner of said Lot 12; thence south along easement along the west lines of Lots 12,13,14,15 and 16 of said Replat, to the south- west corner of said Lot 16 where a manhole will be built which will be the terminus of Lateral 304. Section 5. Lateral Sanitary Sewer District Number 305. That there be and there is hereby created, Lateral sanitary sewer district in the City of Salina, n D 1 CONSOLm •.I F' -SALIN Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 305 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: All of Blocks 1 and 2, Wymore's Addition to the City of Salina, Saline County, Kansas Section 6. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said lateral Sanitary Sewer Number 305 as created by Section 5 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at a manhole seven I feet west of the center line of Ohio Street and on the center line of easement of Block 2, Wymore's Addition; thence west along the center line of easements in Block 1 and 2 of said Addition to a point 70 feet east of the east line of Roach Street where a manhole will be con- structed which will be the terminus of Lateral 305. Section 7. That the City Engineer shall on or before =, 1954, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of the proper character to serve the i property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City i Clerk shall advertise for theee consectutive days in the official city paper for i sealed propesals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there bg any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such Hsi estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 8. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon Section 9. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterest appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces I of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesiad, without regard to the buildings or improvements thereon, and after 1 1 1 making such appraisements, shall return to the Board of Commissioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appriased as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 10. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and ins property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty days from the time such assessment is fixed. Section 11. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Connnissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual install- ments, togehter with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Conor dssioners shall appottion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments cover- ing the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable therefor, and with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each such tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a :�W full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per centux per annum on such amounts so certified, which amounts shall be collected as other taxes are collected.
